Freedom of Information Request F19-270

 

Thank you for your request for information as copied below. You have asked
the House of Commons for all correspondence between the Women and
Equalities Committee and Janet McDermott, Karen Ingala Smith & Diana James
regarding an oral evidence session on 22 May 2019.

 

This information is held by the House of Commons, and please find attached
20 emails and 3 letters in scope of your request.

 

Please note that the personal contact details/addresses of parties, along
with the names of some staff members on the Women and Equalities
Committee, have been redacted to avoid the unwarranted disclosure of
identifiable individual’s personal data. This information is exempt from
disclosure by virtue of section 40 (2) of the Freedom of Information Act
2000 (FOIA), as release of this information to the public generally, in
the House’s view, would not be consistent with data protection principles
in Article 5 of the General Data Protection Regulations. This is an
absolute exemption and the public interest test does not apply.

 

In addition, the House of Commons holds other correspondence within scope
of your request, which directly relates to the proceedings of the Women
and Equalities Committee. Details relating to a Select Committee’s
discussions are subject to parliamentary privilege and therefore this
information is exempt from disclosure under section 34(1) FOIA. Section 34
exempts information from disclosure so far as it is required to avoid any
infringement of the privileges of the House, which includes the privilege
of the Committee to decide whether, when or how to disclose material it
holds.  This is an absolute exemption and the public interest test does
not apply.

 

 

You may, if dissatisfied with the handling of your request, complain to
the House of Commons. Alternatively, if you are dissatisfied with the
outcome of your request you may ask the House of Commons to conduct an
internal review of any decision regarding your request.  Complaints or
requests for internal review should be addressed to: Information Rights
and Information Security Service, Research & Information Team, House of
Commons, London SW1A 0AA or [1][House of Commons request email].  Please ensure
that you specify the full reasons for your complaint or internal review
along with any arguments or points that you wish to make.

 

Following an internal review, if the decision to apply s.34 (parliamentary
privilege) of the FOIA is upheld, a certificate signed by the Speaker may
be issued.  This certificate provides conclusive evidence that the
exemption was required for the purpose described in our response.
