REQUEST FOR INFORMATION UNDER THE FREEDOM OF INFORMATION ACT 2000
(‘The Act’)

Thank you for your recent request under the 2000 Act made on 22 January
2009 at 19.33, which we received on 23 January 2009.

Request:
Kindly send copies of all correspondence between the Leader of
Elmbridge Borough Council (Roy Taylor), Lexington Communications,
Gladedale Group, Network Rail and Royal Star & Garter Homes.

Second email: This request includes all emails, letters or other
communications.

The Head of Executive & Members Services has looked into this matter
and checked with the Leader of the Council about your request.

The Leader of the Council has located and provides the attached letter.
The letter refers to arranging a meeting, which is only available in a
draft form.

Please note that we are instructed that an informal meeting did take
place on 21st July 2008 attended by a small number of cross party
Councillors and representatives from Gladedale. The Leader has stated
that he has no other correspondence pertaining this request.

We are further instructed that the Leader has been the recipient of
countless letters from Gladedale, Star & Garter and Network Rail
promoting their application, but he has not responded to any, nor has he
retained any.

If, for whatever reason, you are unhappy with our response, you have
the right to ask for an internal review. Internal review requests
should be submitted within two months of the date of receipt of the
response to your original letter and should be addressed to Head of
Legal Services, Elmbridge Borough Council, Civic Centre, High Street,
Esher, Surrey KT10 9SD.

Should you then remain dissatisfied at the outcome of that process, you
are entitled to appeal against the decision by contacting The
Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow,
Cheshire, SK9 5AF.

The Head of Executive & Members Services has looked into this matter
and instructs as follows:

“Where the Leader of the Council corresponds/holds information in
relation to his party political or constituency role, the Freedom of
Information Act is not engaged - in simple terms, it is not information
held by the Council. However, where the Leader of the Council has
corresponded on a matter on behalf of the Council / planning authority,
this comes within the ambit of the Freedom of Information Act and
accordingly, relevant information would be provided following any
specific request in this regard.

Contact information is published in respect of all Councillors,
including the Leader of the Council, and that correspondence is sent
directly to or redirected to the Member concerned. The Leader of the
Council (and indeed other Councillors) is responsible for handling his
own correspondence, constituency and party political matters."

If, for whatever reason, you are unhappy with our response, you have

It would be procedurally incorrect if not improbable that the leader failed to reply to this formal and legal letter, or not to have retained a file copy of his response. As you say, this comes within the ambit of the Freedom of Information Act and
accordingly, I require you to supply his response(s) to this letter under the freedom of information act.
