Dear Ms Woollcott,
As you are aware, In line with our duty to provide advice and assistance to requestors under section 16 FOIA, we promptly wrote to you to establish your identity to allow us to verify the validity of your requests. The ICO makes clear that this duty extends to requestors who have made invalid requests and so we would be grateful if you could please provide us with some further identification to enable us to verify your requests and comply with our obligations under the FOIA.
To assist in verification of identity, we require an official piece of documentation with your name and address on it. this could be for example a bank statement, council tax, utility statement. A photo of the document with clearly visible information and with the 4 edges of the document clearly visible is preferred.
We are aware that you have directed multiple FOIA requests to different academies within the Trust however please note that for the purposes of the FOIA, each academy is not a separate public authority. The public authorities subject to the FOIA regime are set out in the Schedule 1 FOIA. In particular, at paragraph 52A, Part IV, Schedule 1 it specifies that in the case of academies, the public authority is the “proprietor of an Academy, in respect of information held for the purposes of the proprietor's functions under Academy arrangements”. “Proprietor” is defined in section 579(1) Education Act 1996 as “the person or body of persons responsible for the management of the academy”. The academy trust is the body that meets this definition and so it is only The Challenge Academy Trust that is a public authority for the purposes of FOIA.
