We write in response to the freedom of information requests you have
submitted, referenced above.  The Council considers these requests to be
related and notice is given pursuant to Section 17(5) of the Freedom of
Information Act 2000 that the Authority is not obliged to comply with your
latest request (reference F2014.12.847) as the Authority estimates that
the cost of complying with this would exceed the appropriate limit.  When
the Council estimates whether the appropriate limit is likely to be
exceeded, it can include the costs of complying with two or more requests
if the conditions laid out in regulation 5 of The Freedom of Information
and Data Protection (Appropriate Limit and Fees) Regulation 2004 SI 2004
No 3244) can be satisfied. Those conditions require the requests to be:

 

•       made by one person, or by different persons who appear to the
public authority to be acting in concert or in pursuance of a campaign;

•       made for the same or similar information; and

•       received by the public authority within any period of 60
consecutive working days.

 

The information requested is therefore being exempted under Section 12.

Can you please advise of how you have come to the conclusion and decision that you may pool my DIFFERENT individual information requests together in order that YOUR now newly created and amalgamated request can be interpreted as one request in order to avoid providing the information?

You responded to my last two requests stating that they exceeded the time allowed under the Act and would therefore be refused however after revising my different requests in order to comply with the exceeding of the time limits and allow you the opportunity to provide the information you have now decided to pool the requests together and refuse the information.

Now one must assume that by behaving in this manner you do not wish to release this information for whatever reason. However I ask that you supply the requested information in the interests of transparencey for the taxpayers of knowsley as a considerable amount of public money has been awarded to this particular company and it is in the public interest for this information to be made freely and readily available.

Further to your emails dated 13 March 2015, the Council’s reasons for its
approach were set out in the Council’s email to you dated 12 March 2015.

 

Specifically that the Council is entitled under the Freedom of Information
Act to take into consideration time spent considering and responding to
your request reference F2014.12.848 and your subsequent clarification in
addition to the estimated time that would be spent considering and
responding to your clarified request reference F2014.12.847.

 

Also that the Council is entitled under the Freedom of Information Act to
consider the costs of complying with requests made by different persons
which are similar in nature – in this instance a number of requests
similar in nature made via ‘whatdotheyknow.com’.
