Further to the presentation by Bill Gilchrist (Environmental Health Officer to the Planning Cttee of 13 January 2023 regarding application 21/0262/PP, we request copies of all communications, including emails, letters, photographs and notes of site visits (including dates and times etc) and details of conversations between Officers of East Ayrshire Council and Mr Frank Smith, Holm Farm, Crosshouse, between the dates of 26 October 2022 and 13 January 2023. In addition, we request a copy of the written statement given by Mr Gilchrist at the Committee meeting of 13th January 2023.

Good afternoon,

 

In answer to your request, I am enclosing the note prepared by Bill
Gilchrist for the Planning Committee, and a report run from the management
information system which details all actions taken by the Environmental
Health Service in respect of the planning consultation.

 

You have further requested emails/correspondence between planning officers
and Mr Smith.  Such information is, in terms of Section 38(1)(b) of FOISA,
absolutely exempt from a freedom of information request and cannot be
provided within the terms of the legislation, as releasing this
information to you would mean releasing personal information relating to
Mr Smith.  As such, I am not releasing emails sent between Mr Smith and
the EH team.

 

I trust this information has been of assistance to you and I have attached
a leaflet to confirm your rights.

Dear East Ayrshire Council,

I am writing to request an internal review of East Ayrshire Council's handling of my FOI request 'Correspondence and communicatons between Environmental Health and Frank Smith Holm Farm, Crosshouse'.

The EHO Dept have confirmed that there are emails between Mr Smith and the EH Team but refuse to release them. A Statement by Mr Gilchrist (Head of EH) provided to Councillors in the determination of a planning application clearly illustrates significant engagement with an objector resulting in the refusal of planning permission for a housing site allocated in the adopted LDP. In the interests of transparency it is important that the applicant and indeed the public are made aware of the engagement between Council officials and objectors to ensure no prejudice to applicants for planning permission. The information requested clearly exists and any personal information could be redacted.
