Dear South Norfolk District Council,

the minutes of the Environment,Regulation and Planning Policy Committee of 24 November 2014 identify that the Council's Enforcement Policy was to be considered on 26 January 2015. This did not happen, and there appear to be no further meetings of the Committee.

Which function in the Council following management of the Council's lawyers being transferred to nplaw is responsible for applying the Code for Crown Prosecutors to a decision to take enforcement action. Did this activity transfer in 2012 when the Council's lawyers (i.e. Solicitor to the Council) transferred to nplaw. Prior to 2012 the Solicitor to the Council was responsible for advising as to the Code for Crown Prosecutors.?

Please provide copies of the documents identifying that the Enforcement Policy should not be considered on 26 November 2014 and when the Council shall be adopting a revised policy

Dear Mr Carruthers

I refer to your Freedom of Information request to which I am now in a position to respond. My response is outlined below along with your questions for ease of reference.

With regard to applying the Code for Crown Prosecutors, this Code is required to be applied by the Crown Prosecution Service or others prosecuting on behalf of the Crown. The Council’s solicitors (nplaw) are well familiar with the Code. In so far as they may consider it good practice for the Code to be applied in relation to local authority prosecutions, the Council’s solicitors will ensure that the Code is applied in terms of advice given and in the conduct of any prosecutions of which they have conduct

With reference to documents identifying that the Enforcement Policy should not be considered on 26 November 2014 (I believe that you are referring to 26 JANUARY 2015) and when the Council shall be adopting a revised policy, I attach one email.
