Dear Nicola,
Thank you very much for your previous answer to my query concerning the ORIGINAL application to VOA to reduce the rateable value of Offa's Dyke Coastal Centre from £5,700 to £2,750. I presume as there were errors in the form . Then a copy of the paper work was simply recycled to save storage space?

1) Could I under the Freedom of Information Act request a copy of the original marked evaluation sheets for both myself and Lisa Cywinski. With Weighting, Score 0-10 and Weighted Score.

1a) As I understand Mrs. Cywinski didn't actually bring a business plan and marketing plan and had nearly a week after interview to supply one?

2)Could I also request details of any monitoring rules and regulation in running (Café Cymru) or Café Cymru (Prestatyn) Ltd. Owned by Cllr G. Percival and Mrs. L. Cywinski. (As it is now and confirmed in previous Freedom of Information Act request.)

Namely a copy of the signed lease.

3) With reference towards the evaluation sheets, would Sue Hagarth (Principal area regeneration & investment officer) as she interviewed myself and Mrs. Cywinski. Be the best person to ask about the scoring 'system.' As I note there were 18 questions on the invite to interview. Including health and safety certification, staff food hygiene and the obvious you and your staff food safety training. But was reduced to just 10 on the scoring evaluation sheet I have seen?

I am writing to request an internal review of Denbighshire Council's handling of my FOI request 'Copy of the original marked evaluation sheets for both myself and Lisa Cywinski.’

While I note you’re reply (below) to my previous questions concerning the interview process of Mrs. L. Cywinski and myself. I wish you to review answers A1 in the light of you supplying personal information of the photocopied lease agreement. Naming Geoff Lawman (address withheld by myself) and therefore in my opinion more significant to section 40 (whole) of the Freedom of Information Act personal information opt out. As the marking sheets are simply the opinion of Denbighshire County Council staff. I consider their opinion, just that and doesn’t infringe on any personal data. I therefore wish to have this question re-asked and supplied, please.

Answer A1a. I though was clear as you have supplied information confirming Mrs. L. Cywinski didn’t bring a business /marketing plan to interview. But wished to reconfirm this as Mrs. L. Cywinski is contradicting this verbally to myself. I therefore ask this as a question. Was the previous information that Mrs. L. Cywinski didn’t bring a business/marketing plan to interview as previously supplied by Denbighshire County Council to Anne Jones AM Correct?

Answer A3. I’ll take your advice and ask a formal question to Sue Hagarth. As I consider she will be able to answer the question thoroughly concerning, Health and Safety Certificates and the all-important Food Hygiene Certificates. As it is my understanding these weren’t in place at the opening of business.

A1. The panel discussed this part of your request and the issues surrounding the section 40 (2) exemption. Having taken into account the November 2008 Information Commissioners Office decision (FS50088016), which concluded that information contained within score sheets is personal data, it was decided to uphold our original decision. This decison can be viewed on the Information Commissioners Office website (http://www.ico.gov.uk/upload/documents/d...)

Q1a. I though was clear as you have supplied information confirming Mrs. L. Cywinski didn’t bring a business /marketing plan to interview. But wished to reconfirm this as Mrs. L. Cywinski is contradicting this verbally to myself. I therefore ask this as a question. Was the previous information that Mrs. L. A1a. I can confirm that Mrs Cywinski did bring a business plan to the interview but was allowed an extra period of three working days to provide further financial information, which was actually provided within 48hrs.

Dear Denbighshire Council,

THE RULING STATES:-
1 August 2005 DFID will, in accordance with the European Court of Justice ruling on the Alcatel Case, be providing the following information when issuing notification of an award decision:
• The award criteria;
• Where appropriate, the score the tenderer obtained against those award criteria;
• The name of the winning tenderer.

And goes on to justify it's ruling of non disclosure of score sheets:-

89.The Commissioner is conscious of DFID’s decision following the European Court of Justice ruling on the Alcatel Case to disclose the following when issuing notification of an award decision: the score awarded to the tenderer against those criteria; and the name of the winning tenderer, when issuing notification of an award decision. However, as DFID only started publishing this type of information in August 2005 which was a number of months following completion of the tendering process for this contract it is clear that Mr Preston’s expectations could not have been shaped by DFID’s decision to follow the Alcatel Case.

90.There is therefore an element of speculation in the Commissioner’s determination as to what Mr Preston’s expectations would have been with regard to disclosure of the various the score cards which follows:

91.The Commissioner notes that under previous tendering processes i.e. those which pre-dated the process under which Mr Preston won this contract, DFID did not disclose the score cards of winning tenderers. Consequently, in the Commissioner’s opinion it would have been reasonable for Mr Preston to assume that the score cards used to assess his tender would also not be disclosed.

As it is clear that Mrs Cywinski score sheet was from 2009, well after the European Court of Justice ruling 2005. It could be fairly assumed any public body would, if requested publish such score sheet/s.

I would politely ask that the 1st August 2005 European Court of Justice ruling be followed.
