Dear West Yorkshire Police,

This is a request for disclosure made by way of the Freedom of Information Act, 2000.

Please supply a copy of the press release issued to local media in October, 2013 appealing for public assistance in locating a dark coloured 4x4 vehicle that was believed to be associated with an incident that occurred in Rayleigh Street, East Bowling, Bradford BD4 7JR at around 2am on 14th October, 2013.

I am writing to request an internal review of West Yorkshire Police's handling of my FOI request 'Copy of press release'.

May I respectfully request that the reviewer considers the following points:

1. The incident that occurred in Rayleigh Street, Bradford was the murder of a 50 year old male in the early hours of 14th October, 2013. It was linked, by the Mitsubishi vehicle, to an earlier incident in Farway, Holme Wood, Bradford.

2. Because of the nature of the attack on the subject male (firearm and acid), the criminal investigation became high profile.

3. It became clear during the criminal trial that the police investigation was codenamed Operation Posehaven.

4. The appeal for information about the Mitsubishi was fronted by the senior investigating officer (SIO), Supt Wallen. It was made approximately one week after the incident.

5. The convictions of four men at the conclusion of the murder trial have been the subject of appeal to the Court of Appeal (heard in June, 2016) and numerous subsequent applications to the Criminal Case Review Commission.

6. At least one, and possibly two, of those applications is extant.

7. One of the applications, submitted by the individual referred to as 'the principal', has resulted in a referral by the CCRC back to the Court of Appeal.

8. In those circumstances, it is inconceivable that, absent of a positive action of deletion or destruction, West Yorkshire Police does not hold the requested information.

In the light of the WYP response I request the following further information (it is understood that this will fall under a new reference number):

A. On what date was 'the system used to log this information replaced'?

B. What information is held regarding the rationale for not transferring data from the old system to the new?

C. At what rank was that decision made?

D. Did the decision not to transfer information from old to new conform with the College of Policing's Authorised Professional Practice?

E. Which business areas (eg HMET, PSD, press office) provided responses in connection with FOI request 1870904/23?

F. At what rank was the finalisation of that same FOI response quality assured?

G. Copies of internal correspondence relating to FOI request 1870904/23. As FOI requests are, by law, 'applicant blind' this should not involve my personal data. Which would, of course, involve a data subject access request.

As FOI requests are, by law, 'applicant blind' this should not involve my

Section 17 of the Act provides:

(1) A public authority which, in relation to any request for information,
is to any extent relying on a claim that information is exempt information
must, within the time for complying with Section 1(1), give the applicant
a notice which:-

(a) states the fact,

(b) specifies the exemption in question, and

(c) states (if that would not otherwise be apparent) why the exemption
applies.

 

The Freedom of Information Act 2000 obliges us to respond to requests
promptly and in any case no later than 20 working days after receiving
your request. We must consider firstly whether we can comply with S1(1)(a)
of the Act, which is our duty to confirm whether or not the information
requested is held and secondly we must comply with S1(1)(b), which is the
provision of such information. However, when a qualified exemption applies
either to the confirmation or denial or the information provision and the
public interest test is engaged, the Act allows the time for response to
be longer than 20 working days, if the balance of such public interest is
undetermined by virtue of Section 30 – Investigations and Proceedings
Conducted by a Public Authority.

 

In this case, we have not yet reached a decision on where the balance of
the public interest lies in respect of either of the above obligations. We
estimate that it will take an additional 20 working days to take a
decision on where this balance lies.

 

I would like to apologise in advance for the delay in responding to your
