Copy of ombudsman letter

"e) I can confirm that Powys County Council has received a response from the Ombudsman to the letter that was sent by Powys County Council's Rights of Way Committee on 28th October 2011. I would clarify that we were not actually aware of this response until 24th February 2012, when it was resent by the Ombudsman, as the original postal copy seems not to have reached us successfully.
The letter addressed to the current Chair of the Rights of Way Committee, has not yet been considered by the Rights of Way Committee and a decision on its content has therefore not yet been made.
I regret we are therefore unable to provide you with a copy of the letter at this time. Information contained in any ‘internal communication’ of a public authority, which also includes communications from inspectors and other government agencies, is protected from disclosure in accordance with Regulation 12(4)(e) of the Environmental Information Regulations.
The exception exists to allow public authorities the time or space to allow them to consider communications received and make decisions on the particular issue contained within.
We recognise that disclosure of information enables proper public participation in the decision making processes of the Council, however in this case the communication has not yet been presented to and considered by the Rights of Way Committee . It is therefore not appropriate to disclose this information at this time."
Will you please now provide a copy of the letter, or a link to the letter, from the Ombudsman, in reply to the PCCROWC letter dated 28th October 2011.

the statutory timescale of 20 working days as defined by the regulations,
subject to the information not being exempt or containing a reference to a
third party. In some circumstances Powys County Council may be unable to
achieve this deadline. If this is likely you will be informed and given a
revised time-scale at the earliest opportunity.
There may be a fee payable for the retrieval, collation and provision of
the information you request. If this is the case you will be informed and
the 20 working day timescale will be suspended until we receive payment
from you. If you choose not to make a payment then your request will
remain unanswered.
Some requests may also require either full or partial transference to
another public authority in order to answer your query in the fullest
possible way. Again, you will be informed if this is the case.
The due date for responding to this request for information is February
26, 2013.
