Thank you for your Freedom of Information request which we received on

I can confirm that Eastleigh Borough Council does hold the information
requested. The Council consider the requested information to be exempt
under Section 12 of the Freedom of Information Act (FOIA) 2000.

 

Section 12 of the Freedom of Information Act (FOIA) 2000, provides an
exemption from the obligation to comply with a request for information
where the cost of compliance is estimated to exceed the appropriate limit.
This is an absolute exemption. The appropriate cost limit is set out in
section 3(3) of The Freedom of Information and in the Data Protection
(Appropriate Limit and Fees) Regulations 2004, which for the Council is
£450 (which equates to 18 staff hours). The information you have requested
is therefore exempt under section 12 of the FOIA, as it is estimated that
to retrieve the information would take in excess of 20 hours.

Thank you for your response. Under FOI law, section 12, I believe you should have also provided me with some advice or guidance on how I may refine my request so it can be dealt with under a reasonable cost.

Section 16(1) – (2) states as follows:
16. — (1) It shall be the duty of a public authority to provide advice and assistance, so far as it would be reasonable to expect the authority to do so, to persons who propose to make, or have made, requests for information to it.
(2) Any public authority which, in relation to the provision of advice or assistance in any case, conforms with the code of practice under section 45 is to be taken to comply with the duty imposed by subsection (1) in relation to that case.

I request an internal review of the above decision for refusal, and your decision to not provide me any advice or guidance on refining my request.

I would also now like you to provide all information which you can UP TO the 18 hour staff time cost limit please.

I write with reference to the above. I have now reviewed your request and
the Council’s refusal notice.

 

I acknowledge that in this instance the Council has failed to comply with
the requirements of section 16 of the Freedom of Information Act 2000.
Please accept my apologies for the failure to provide advice and
assistance in refining your request. I understand that you have now
refined your request somewhat, and the information is now to be given.
Whilst I consider the original refusal was justified due to the volume of
requests received by the Council each year, and to locate and retrieve the
information would have taken in excess of 18 hours, I agree that advice
could have been given to you as to how to limit the scope of your request.
I would take this point to let you know that we are currently undergoing a
digital redesign programme, and will shortly have a new website. Once this
is live we may well add Freedom of Information requests and responses to
the website in due course, with a view to being more transparent.

 

I trust that this fully answers your request for internal review. However,
if you are not happy with the outcome of your request for internal review
you may apply to the Information Commissioner’s Office for a decision, at

Dear Shikdar, Nelupa,

My original request was for the period of 1/1/17 to 10/8/17.

You first refused my request as it “exceeded the 18 hour cost limit”. I then asked for everything to be provided up to the 18 hour limit, which you have now disclosed.

You have disclosed information for the period of 1/1/17 to 25/9/17. This proves that your original refusal was unjustified and the time estimate unreasonable as you have (within 18 hours) managed to collate my requested period plus another 32 working days worth of information.

I shall be contacting the ICO with a complaint regarding the delay taken on this case.
