Thank you for your email dated 27 September asking for a list of all
appeals for Certificate of Lawfulness Proposed Use or development
associated with the original application being a prior approval, from the
years Jan 2009 until September 2019.

 

I am afraid we cannot pick out the information on lawful development
certificate appeals and prior approval and I know you explained a list of
appeals would be sufficient, if we don’t have information as to whether
the original application is a prior approval. I have attached a copy of a
spreadsheet giving the appeal references for  between these dates. Please
note that, apart from possibly in the early stages of the time period
mentioned (with LD1 and LD2), the appeals are not categorised specifically
as you ask. The Planning Inspectorate does not record lawful development
appeals in such a way that we can readily distinguish between S191
(existing) and S192 (proposed). It is likely that it can be captured from
the decisions and indeed the fuller circumstances are likely to be
apparent. We do not hold decisions that are older than five years.
Decisions within the last five years are in the public domain and you are
able to carry out your own research from the information that is made
publicly available.
