Thank you for your request for a copy of all applications for costs submitted as part of an appeal for the last 10 years.

I have considered your request but am unable to supply the information that you have asked for, for a number of reasons.

There are approximately 17,000 costs applications that have been decided by the Planning Inspectorate in the last 10 years. It is not possible to send you information on this scale as the number of documents combined with the time it would take to collate them in order to send them to you would require resources beyond what the Planning Inspectorate has available.

However, in reality we will only have access to those costs applications which have been decided in the last calendar year as we operate a file retention policy under which we destroy the majority of appeal files after 1 calendar year (certain casework types have different file retention periods). Whilst I do not have an exact number of costs applications submitted in the past calendar year I can confirm that in 2018 we issued 1,226 costs decisions, and in 2019 until the end of October we have issued 983 costs decision.

Whilst this fact significantly reduces the number of costs applications that it might be possible to send to you, in practice the number is still too large to make it possible for us to comply with your request. Each costs application is submitted individually to the Planning Inspectorate and is held on the original appeal case file for the appeal. To provide you with copies of the costs application would involve re-opening each of the relevant appeal casework files, extracting the cost application, where necessary redacting any sensitive or personal information, and re-formatting it so that it would be suitable to send to you. To do so around 1,000 times is not possible. I am therefore sorry that I cannot provide the information that you have asked for.

You may find it useful to note that appeal decisions and costs decisions (although not the applications themselves), where they have been published in the public domain will be held on the Appeal Casework Portal for 5 years after the date of the decision: https://acp.planninginspectorate.gov.uk/

However, I am again sorry that I have been unable to help you on this occasion. If you are unhappy with the outcome of your request for information, or the way we handled your request, then you can ask for an internal review. In line with my previous email to you dated 18 November 2019 I cannot provide you with the full information that you have requested, for the reasons given in that email. However the Planning Inspectorate does now publish our appeals data on our website at the following link: https://www.gov.uk/government/statistics...

The data set contains a number of fields that you can use to conduct your own search. Column AR identifies all cases for which a costs decision has been made. This data covers the last five rolling years of decided appeals, and is updated every quarter (approximately six weeks after the end of the particular quarter in the year). You can use the appeal reference to look up the costs decision on our Appeals Casework Portal: https://acp.planninginspectorate.gov.uk/. Local Planning Authorities are required to retain all appeal documents and to make them available for public view upon request, and therefore may be able to provide copies of individual costs applications.
