I am writing to request an internal review of University of Derby's handling of my FOI request 'Copper Building - Fire Safety Strategy internal audits'.

The university has provided an undated letter as part of its 31.03.21 response my FOI request of 04.02.21. The letter from the university claims exemption in circumstances where there is a clear public safety and law enforcement interest in disclosing the requested information.

The public interest and law enforcement elements are particularly relevant in circumstances where Derby City Council has already confirmed that the 2015 planning application that sought 'change of use' featured supporting architectural drawings that depicted a fire escape as being in place when it was not actually constructed until 2018.

It is unfortunate that Derby City Council changed its responses on the matter of the missing fire escape the day following the Grenfell Towers fire in June 2017 and that, according to the university's records, no notification or update was made on the related compliance requirement per Part B Building Regulations 2000.

In relation to the University's recent responses following the intervention of the Information Commissioner's Office:

I am in receipt of the document provided on 24.01.22 and can confirm that this is a duplicate of the document previously provided (without password security) on 31.03.21.

I am also in receipt of the document provided on 14.01.22.

I note that the latter document originates in October 2017 following a formal notification to the Vice-Chancellor of a threat of enforcement action (building closure - fire safety) by Derbyshire Fire & Rescue Service, and that this action taken by DFRS occurred as a result of a change of focus by Derby City Council following the Grenfell Tower fire in June 2017.

Unless there are more documents to come, I will be asking the ICO to initiate a section 77 FOIA investigation on records that have either been withheld or destroyed.

Dear UOD - FOI,

Further to my response of 25.01.22, I can now confirm that part of the still awaited response to my FOI on Fire Safety Strategy for the Copper Building at One Friargate Square relates to records resulting from my email communication to the Acting Head of Law on 06.10.15 in which I blew the whistle on the lack of fire escape in the six storey building. Evidence gathered from other sources confirms that a Building Control Final Certificate (partial) was issued in respect of the Copper Building by the building control consultants on 08.10.15. The Final Certificate makes no reference to the lack of fire escape whatever.

However, during a meeting on 09.10.15, it became clear that the Head of Law had received a briefing on the University's requirement to complete a fire escape in early 2016. This is supported by an invitation to tender (ITT) document, published by the University in December 2015 (provided by other sources), to construct the external fire escape depicted on the architect's plans in April 2015 (fraudulently used for a change of use planning application). That ITT was later cancelled in 2016 after commercial bids had been received.

Other sources have also provided details of the discussions around fire safety strategy from 2015 onwards.

Given the circumstances referenced above, as well as the threat from Derbyshire Fire & Rescue Service to close the building referenced in my WDTK message of 25.01.22 (above), it is inconceivable that the University holds no records relating to the lack of fire escape in the Copper Building. Similarly, it is also inconceivable to claim that there are too many related records to process an FOI response.

I will add this matter to the formal s.77 FOIA complaint.

• Letting us know of specific emails that you are aware of in order for
us to refine our search criteria.

To clarify, the University used a plethora of search criteria (Paras 114 and 116 of the Decision Notice) when conducting the email searches.

Therefore to assist in narrowing this criteria down would you be in agreement that we use the following criteria only:

The University has a clear instruction on search criteria in the form of a Final Notice from the ICO.

Note that on 05.07.21, the University's Vice Chancellor received a formal written notification to pause any related retention schedule:

"Dear Professor Mitchell

Litigation requirement to pause UoD documents retention policy

Further to my email of 02.07.21, I can confirm as follows:

Following detailed investigation of breaches of building control fire safety regulations related to the One Friargate Square Law School building, I am writing to you to formally put the University of Derby on notice that it must pause its document retention policy in respect of all records related to the referenced building. This requirement includes the ‘initial notice’ sent by MFA Building Control Ltd on 07.07.15 and all related communications with any parties, to include any ‘final certificates’.

You will be aware that there are important records held by the university related to the building that date back to 2015 that may be required as part of a criminal prosecution. Whilst we have already sourced some of the documents from internal sources and other organisations, I am aware that, although a six-year retention policy may be regarded as 6+1 years in some universities, that policy is not uniformly applied across the UK.

Please feel free to contact me on the number above should you require further clarification."

I suggest that the University liaises with the ICO to confirm its approval of any searches conducted but I would expect that to also include the words "Initial Notice", "ITT", "Invitation to Tender", and "FGS", as well as the words referenced in your response to me. Any search should also include email archives related to ex-employees.
