Thank you for your recent email shown below, apologies for the slight
delay in responding to you. 

 

The Council is refusing your request and has relied on the exemption
contained within section 22 (1) in refusing your request.  Section 22 is
“Information intended for Future Publication”.  See additional detail
below on the use of this exemption:-

 

This month, The Department for Communities and Local Government has issued
its Local Government Transparency Code 2014.  This Code requires Local
Authorities:-

Proactively and routinely publish some types of data

Publish some types of data on an annual basis

Gives recommendations for some additional data types to be published

 

Local Authorities have a 6 month period from May 2014 to comply with the
code.

Invoices are required to be routinely published and the Council will
therefore be proactively and routinely publishing invoices within the next
6 months.  Your request is therefore refused and we have relied on the
exemption contained within Section 22 (1) of The FOI legislation. 

This exemption does not require for a publication date to be determined,
but it will be within the next 6 months.

 

You have the right to ask for an Internal Review of the refusal to supply
some of the information requested and this should be addressed to

Officer. 

 

If you remain dissatisfied with the result of any Internal Review then you
may complain to the Information Commissioner at

I have read the Local Government Transparency Code 2014 and it does require you to publish invoices for expenditure over £500. However the Local Government Transparency Code 2014 does not require invoices created before the Local Government Transparency Code 2014 was published to be published. The Transparency Code 2014 was published in May 2014 and does not apply retrospectively to invoices from February 2014.

Therefore there is no requirement on Wirral Council due to the Local Government Transparency Code 2014 to publish these invoices which were created prior to the Local Government Transparency Code 2014 being published.

I therefore request an internal review of the invoices side of this request on the grounds that the Local Government Transparency Code 2014 does not place a requirement on Wirral council to publish the invoices that this FOI request is about, but only invoices created after the Local Government Transparency Code 2014 was published. Therefore the exemption in s.22 would seem not to have been applied correctly.

Of course, Section 22 is not an absolute exemption. Data can only be withheld if the council has weighed the pros and cons and concluded that the public interest in maintaining the exemption is greater than the public interest in providing the information.

I think the powers that be, are always hoping that if replies are delayed long enough, some of the good folk making enquiries will have an accident or die during the wait. These people remind me of a boxer running around the ring in the hope of not being hit.
