internal review of a response provided by the Air Command Secretariat on
behalf of the Ministry of Defence under the Freedom of Information Act,
dated 18 August 2023 (reference: FOI2023/09055).

 

The Department's target for completing internal reviews is 20 working days
from date of receipt and we therefore aim to complete the review and
respond to you by 22 September.  While we are working hard to achieve
this, in the interests of providing you with a realistic indication of
when you should expect a response, the majority are currently taking

I am writing to request an internal review of Ministry of Defence's handling of my FOI request 'Copies of US JFS ESC AP MOA (JTAC) and AJP-3.3.2 (B)'.

1. I challenge the application of sections 40 and 27 to the signatories pages redacted from the current JTAC MOA.

A previous version of this unclassified MOA dated "4 March 2021 Change 2 (16 February 2022)" is already in the public domain complete with names and signatures of the US Director of the Joint Staff, Service Operations Deputies, USSOCOM Deputy Commander, and equivalent participating Partner Nations.

It follows that sections 40 and 27 of FOIA are not correctly applied in this case.

Effective Date, Review, and Withdrawal. This MOA, including all Appendices and
enclosures, has an effective date of the DJS signed implementation memo. The MOA will be
reviewed every three years, and updated as required. Updates that change MOA intent or add
issues not previously addressed will be coordinated through the JFS ESC and the Joint Staff
Action Process, and will be signed by the Director of the Joint Staff, Service Operations
Deputies, USSOCOM Deputy Commander, and equivalent participating Partner Nations.
Updates that do not change the intent of the MOA will be reviewed and approved by the JFS

Decision (including any steps ordered)
1. The complainant submitted a request to the Ministry of Defence (MOD)
seeking information a copy of a particular US memorandum of
understanding and a copy of a particular NATO doctrine. The MOD
provided some of the information falling within the scope of the request
but sought to withhold the remainder on the basis of sections 27(1)(a)
and 27(1)(b) (international relations).
2. The Commissioner’s decision is that withheld information in question is
exempt on the basis of each exemption and that for each exemption the
public interest favours withholding the information.
3. The Commissioner does not require further steps.
