Convicted sex offender Dr Vijay Mahendran

The following disturbing headline concerning Dr Vijay Mahendran has appeared in the Daily Mail:

"Senior doctor, 53, is spared jail after repeatedly groping nurses as court hears he previously threatened to kill his wife with scissors and hit a young child in the face"

The sentencing judge indicated that the GMC would be contacted about the matter, which included a suspended prison sentence and an order requiring Dr Mahendran to sign the Sex Offenders Register for ten years.

I have searched your interim orders tribunals register without success to find his GMC number:

"An interim orders tribunal hearing looks at whether a doctor's registration should be restricted while allegations about their conduct are resolved."

Please provide Dr Mahendran's GMC number and confirm the date of any hearing that has been set to consider his case.

Dr Vijay Mahendran

 

Thank you for our email of 8 January 2020.  I’ve considered your request
under the Freedom of Information Act 2000 (FOIA).

 

I’ve attached a copy of Dr Mahendran’s entry on the publicly accessible
List of Registered Medical Practitioners, available via the GMC website
[1]here; his GMC registration number is 5198149.    

 

I can’t confirm whether or not any information is held by the GMC or the
Medical Practitioners Tribunal Service (MPTS) relating to future hearings
about Dr Mahendran.  This is because it would breach data protection
legislation to do so.

 

We believe it’s reasonable for doctors and complainants to expect that
complaints will be treated as confidential.  If a case progresses to a
public hearing, or the doctor receives a sanction on their registration,
certain information may be made publicly available by the GMC and/or the
MPTS.   Otherwise the information is treated as the confidential personal
data of the doctor and other parties involved. The exemption under the
FOIA is as follows:

 

Section 40(5B)(a)(i) FOIA applies where the information, if held, would be
the personal data of a third party and where confirming whether it’s held
would breach any of the principles relating to the processing of personal
data listed at Article 5 of the General Data Protection Regulation
(GDPR).  To publicly confirm or deny whether we hold the information would
breach the first principle, which requires that the processing of personal
data is lawful, fair and transparent. I do not believe that any of the
legal bases for processing listed at Article 6 of the GDPR are met and
therefore giving you the information would be unlawful.

 

The MPTS publishes notices of hearings in accordance with our
[2]Publication and Disclosure Policy.

 

Your right to appeal
