Conversion from Incapacity Benefit to contribution-based ESA with Income-related ESA top up

The request was successful.

Dear Department for Work and Pensions,

Please supply the official guidance and decision making for conversion from Incapacity Benefit to contribution-based ESA where Income-related ESA should be paid as a top up.

Particularly where Income-related ESA would be eligible as a top up to contribution-based ESA, but was not automatically paid.

Please supply any documents relating to the subject, including the thread
"response to Caffas Noticeboard 05.06.13 Gabby "IB Reassessment, TA and ESA time limiting" in response to Mark Thomas Hanley BC "conversion decision revised for Official error" "
and the consequent responses and other relevant threads

Please can you clarify your response
"Categorisation of converted awards
... was entitled to IB or SDA but not entitled to IS...becomes entitled, following conversion, to income-related ESA as well as contributory ESA ...are placed in the support group and thereby automatically acquire entitlement to the enhanced disability premium...Where this applies, no separate claim for the income-related element in required. "
as answered in https://www.whatdotheyknow.com/request/1...

Please explain with the official guidance and decision making for
"no separate claim for the income-related element in required."

Therefore, how would someone whom is converted from IB, to Contributory ESA but because of being placed in support group acquire entitlement to the enhanced disability premium get the income-related ESA topup, without making a separate claim for income-related element, as described in your response above?

What is the the official guidance and decision making rule for this, what is process for where this has not happened automatically as described in your response above.

And whether or not IS was being claimed, and whether or not entitlement was there for IS as described in "Categorisation of converted awards"

Also you answered
Question 2: Information on the number of ESA cases receiving each payment type at May
2012 (the latest caseload data available), split by whether the claim is an IBR claim or not, can be found at the following link:
http://83.244.183.180/100pc/esa/ib_mig/p...

The link is a internal DWP link not open to the public, Please can you give the number of cases where payment is
IR ESA
CB ESA
CB ESA with IR ESA top up

Yours faithfully,

Anthony Collins

There are 4 mistakes in the response

1-
the link you gave
https://www.gov.uk/government/uploads/sy...

does not break down IR ESA, CB ESA AND CB ESA WITH IR

Please can you give the number of cases where payment is
IR ESA
CB ESA CB
ESA with IR ESA top up

2-
Your response said
https://www.whatdotheyknow.com/request/1...
"no separate claim for the income-related element in required."

What is the the official guidance and decision making rule for this answer the DWP gave?

2-
what is process for where this has not happened automatically as described in your response
https://www.whatdotheyknow.com/request/1...

You did not supply the official guidance and decision making rule for this

4-
The caffas discussion is the DWP Discussion Response Board for Decision Makers internal website
http://51.1.9.250/corporate/acidecision2...

It is the DWP information, it is what DWP setup for discussions for Decision makers, it is a internal DWP intranet

Please give the DWP thread "Caffas Noticeboard 05.06.13 Gabby "IB Reassessment, TA and ESA time limiting"
