Conventional Armed Forces Europe Treaty

Response to this request is long overdue. By law, under all circumstances, Ministry of Defence should have responded by now (details). You can complain by requesting an internal review.

Dear Ministry of Defence,

I am attempting to locate information provided to the UK by the other State Parties under the Protocol on Notification and Exchange of Information of the Treaty on Conventional Armed Forces in Europe. Specifically the information required to be provided under the Protocol as at the date of the Treaty, 19 November 1990 (as referenced by Section VII of the Protocol).

I've not been able to locate this information in the National Archives. I requested it under FOI from the FCO and they have indicated that as the MOD was the lead department on this Treaty the information should be held by you.

I am therefore requesting under the Freedom of Information Act copies of the formal notifications provided to the UK deemed valid at the signature date of the Treaty, 19 November 1990.

Please don't hesitate to contact me should you require additional information about my request. If the information has been transferred to the National Archives, I should be grateful if you could provide me with sufficient information to locate it. Alternatively if you believe the information is still held by the FCO please let me know and I'll make a further request of them.

Thank you for your reply.

I should be grateful if you could please pass this email on to the person who conducts Freedom of Information reviews.

I continue to believe that the MoD should hold this information and I am therefore writing to formally request an internal review of the Ministry of Defence's handling of my FOI request 'Conventional Armed Forces Europe Treaty'.

The FCO has previously replied to me indicating that this information should be held by the MoD as the MoD led on the Treaty for the UK. The Protocol of the Notification and Exchange of Information of the Treaty required the State parties to provide information to each of the other State parties (rather than NATO as suggested in the reply). Article XVII of the Treaty would indicate that the notifications in November 1990 would have been in the form of formal diplomatic communications to the UK from the other State Parties.

I would also note that the MoD has previously published aggregate information received by the UK in respect of information provided in subsequent years (https://www.gov.uk/government/collection.... This would indicate that the MoD was receiving the notifications from other States required under the Treaty.

We acknowledge receipt of your email of 01 February 2019 and can confirm that an internal review will be conducted of your request for information (reference above).

The Department's target for completing internal reviews is 20 working days and we therefore aim to complete the review and respond to you by 4 March 2019. While we are working hard to achieve this, in the interests of providing you with a more realistic indication of when you should expect a response, we should advise that the majority are currently taking between 20 and 40 working days to complete.
