Thank you for your recent request made under the Freedom of Information Act.

Wirral Borough Council did not employee Control Room Operators and do not have a job description with that title. All control room staff work under the Control Room Officer job description which has previously been supplied to you.

Dear InfoMgr, FinDMT,

Thank you for your reply can you please clarify if the staff deployed as control operators work too the Emergency Control Room officers job description or out of hours call handlers job description that have been supplied to me and also what grade are the staff paid?

Further to your recent requests made under the Freedom of Information Act,
Wirral Borough Council has noted a comment made by yourself at the
following link:

A screenshot of this annotation is attached.

 

In this comment, made in the public domain, you identify yourself as
having worked in the Council’s Community Safety team during 2013/14. The
Council, however, has no record of employing an individual by the name of
Robert Kenny in this service area during this time, and must therefore
conclude that ‘Robert Kenny’ is a pseudonym.

 

In accordance with Section 8 of the Freedom of Information Act 2000, a
requester must provide their name for a request to be processed (please
see the guidance from the Information Commissioner’s Office below):

 

What constitutes a real name?

We consider that a relatively informal approach is also appropriate in
this context. Therefore, title and/or first name with surname satisfies
the requirement for provision of a real name, as does the use by a female
applicant of her maiden name. The prime consideration is whether enough of
a person’s full name has been provided to give a reasonable indication of
that person’s identity.

 

Example:

Mr Arthur Thomas Roberts could satisfy Section 8(1)(b) of the FOIA by
stating his name in a request for information as “Arthur Roberts”, “A. T.
Roberts”, or “Mr Roberts”, but not by stating his name as “Arthur” or
“A.T.R.”

 

In most cases, it will be reasonable for a real name to comprise a name by
which the person making the request is widely known and/or is regularly
used by that person and which is not an obvious pseudonym or fictitious
name.

 

The Council consulted with the ICO on this issue, and was advised that as
it has become clear that a false name has been used these requests are not
valid under the legislation.

 

There is therefore no obligation placed on the Council to respond until
your real name is provided.

Thank you for your email.

 

Section 8 of the Freedom of Information Act states that a valid request
must contain the applicant’s name. The Council has previously written to
you on this matter, and you admitted twice (in emails of 1^st and 6^th
July, both of which can be viewed on WhatDoTheyKnow.com) that ‘Robert
Kenny’ was not your real name, and that you were in fact Paul Overend, a
former Council employee.

 

Due to confidential information which has been brought to the Council’s
attention, we are of the belief that there remains a reasonable doubt over
your real name.

 

The Information Commissioner’s Office has [1]published guidance on the
issue of pseudonyms, advising that

 

17. [if] there is no obvious indication that the requester has not used
their real name, then we don’t suggest that the authority takes steps to
check the requester’s identity.

 

On this occasion, we feel that there is an obvious indication that you may
not have provided your real name. Any requests for information you have
submitted would at this time therefore be invalid.

 

The Council has consulted with the ICO on this matter, and both parties
are of the opinion that in this instance it would be reasonable to ask you
to provide proof of your identity before your requests are responded to.

 

In order to progress your enquiries we would require you to provide copies
of any of the documents below to confirm your identity.

 

§         Current Passport

§         Birth certificate

§         Unexpired photo card licence (full or provisional)

 

Photocopies or scanned versions of these documents can be accepted. Please
do not send original documents.
