Control or Eradication of Japanese Knotweed on Princes Parade - pre 2006

Dear Shepway District Council,
This request is raised under the Environmental Information Regulations concerning the Princes Parade land owned by Shepway District Council. The EIR are applicable to this site since it is known to be subject to environmental emissions.
Please provide by email details of the actions taken to control, eradicate or remove Japanese Knotweed from the Council’s Princes Parade land during the period 1 Jan 2000 to 31 Dec 2005, including:
1. For each individual action taken – Description of the method used, name of herbicide used (if applicable), name of the company or person undertaking the work and the date.
2. Evidence that Japanese Knotweed had been eradicated or removed from the site, with date(s), name of company or person that provided the evidence and a final “sign-off” document as confirmation.

I am writing to request an internal review of Shepway District Council's handling of my FOI request 'Control or Eradication of Japanese Knotweed on Princes Parade - pre 2006'.

Thank you for your prompt response.
However, may I ask you to please revisit your various sources of information to check that there really is no information available on work undertaken to deal with Japanese Knotweed on Princes Parade in the period mentioned. I ask this since two public statements have been made recently by council officers that would have required them to have had access to definitive information in justification. Had they not been in possession of such information their claims would have been unsubstantiated, so it should be straightforward to find the evidence.
First, at the 7 Feb 2017 Cabinet meeting, Shepway officer, Mr David Shore, stated that a programme of control had been put in place for Japanese Knotweed during the period 2002 to 2005. Please advise me whether he possesses any evidence that the programme of control actually occurred during that specific period and if so please email me the details of the method of control and the dates.
Secondly, the Press has published (Folkestone & Hythe Express, 8 Feb 2017) a claim by council officials that the knotweed was “removed from the site more than 10 years ago”. I have gained confirmation from both the reporter and his editor that they will stand by their newspaper report that such a claim was indeed made by the council. Please therefore provide the evidence that the Japanese Knotweed was removed from the site, how, by whom and the date(s). If no such evidence exists please advise me of the basis upon which the claim has been made.

I acknowledge receipt of your application for a review of our response of
9 February 2017 to your Environmental Information Regulations request
(dated 8 February 2017).  We will be dealing with this by way of an
Internal Review in line with the procedure outlined in our response.  Your
request will be dealt with in accordance with Shepway District Council's
policy on such matters which is subject to guidance produced by the
Information Commissioner's Office in line with Regulation 11 of the EIRs
and the EIR Code of Practice.

 

We anticipate that the internal review will be completed within 20 working

This is the council’s response to your request for an internal review.

 

I have looked into this matter and concluded that the council were correct
in its response.  The council does not hold the information you have
requested.

In your request you ask: “ If no such evidence exists please advise me of
the basis upon which the claim has been made.”  You are asking for an
explanation rather than for recorded information so this part of your
request does not fall within the ambit of the Environmental Information
Regulations.  However the statement was made based on the contents of the
 statutory declaration made by Mr. C. McCreedy and the fact that there has
been no evidence of knotweed on the site since 2006.
