Contractors and Disclosure Scotland Checks
Dear Sir or Madam,
I was wondering have all outside contractors been checked for criminal convictions before they are allowed to visit people in their homes. If they have not why do we have to let them in to do work on say our central heating systems or gas appliance's surly I do not have to let some one in to my house who may be a danger to myself or property. I refer to two types of contractor MPC and SALTIRE letters keep getting sent out which states if I do not let them in I will be taken to court, surly your duty as a council is to make sure that I am safe in the house you rent out to me, and not threaten court action if I do not trust some one who tries to gain entry to my house.

I see that you will threaten your tenants with court action, but are breaking the LAW by not letting your tenants know that the people who do work for you have been checked and are safe responsible people who are not a danger to them or their families.
You seem to think that the LAW only works for you, I am sorry to say you could also be prosecuted for breaking the law by not informing your tenants, that every one who does work for the Council has been checked and are in possession of Disclosure Scotland Certificates.
These have been a requirement by Law for a number of years, so supply an answer please.

Dear North Lanarkshire Council,
I see that you do not consider the law to be applicable to your selves. If you do not know whether the people who work for you are fit and proper persons to be allowed to go into the houses of your tenants, just tell me and then carry on as before breaking the Law.
You should have responded to this F.O.I. request within 20 days by Law but you have not ( WHY??? )

Dear Cluggie Carol,
I take from your answer you do not consider the Law to apply to your selves in regards the safety of your tenants. I will now take this matter up with the local, national newspapers as the law does state that any one who is in contact with vulnerable people including the elderly, young and infirm are not put at risk because of the failure to check the back ground of people employed in the public service sector for possible criminal activity's.
I will also inform the Scottish Parliament of this complete disregard of the law, and ask them to do a full investigation and report sent to the Procurator Fiscals Office, to make sure that you adhere to the law.

I refer to you request of 12 December and apologise for the delay in
replying.
I have consulted with our legal section and the view is that the type of
work which you are referring to would not be considered as "regulated
work" and as such does not require enhanced criminal record checks. The
examples given of work that does come under the category "regulated work"
is ;childcare,fostering,and includes work in the proximity of schools and
care homes.

Dear Slater Robin,
Thank you for this reply. You make mention that people who work and look after the Elderly, Children and vulnerable people are covered by Disclosure Checks, but these contractors do work in this field. In the sense they are in the houses and in close contact with children, the elderly and vulnerable people.
If even one of these contractors were to molest a child or Rape a woman or even entice a vulnerable person to either commit a crime or to take and use or store drugs this response would allow any one to sue and claim compensation from your council.
I believe that this is such a serious matter that you should look at this very important situation in relation to looking after the people who pay your wages.
