information you wish to receive. To help us to do so, I would be grateful
if you could expand on exactly what is required, particularly to explain

Rather than ask for specific rates, I am asking for the charges by association to one another. the lowest hourly rate charged being assigned ‘1’ and the contractor and area named. The next lowest will be expressed relative to ‘1’ and the contractor and area named. So on and so forth. I restrict this request for information to the staff and vans that go to accidents.

As your request stands, we have estimated that the cost of compiling your
request will exceed £450. Section 12 of the Act does not oblige us to
comply with requests if they exceed this limit.  Therefore, to help us
respond to your request fully, can you please give me an indication of the
timescale that you require this claim information to cover.

 

In addition, your clarification in your email of 15 February 2018, has now
been considered by our appropriate contract managers.  They have now
requested the following additional clarification:

·       Can you please clarify that you are referring to third party
damage to crown property claims works, as this is not explicitly stated in
your emails;

·       What is to be the comparator?  Your request is unclear on what, or
how, you wish to compare;

·       Do you require the information based on just the initial
attendance, or for all costs associated with staff and vans, including any
subsequent make safe and repair?

·       What is meant by “contractor”?;

·       By ‘staff’, do you mean operatives?

·       Do you mean ‘vans’ or any vehicle that is used to attend?    

Please note that if I do not receive appropriate clarification of your

I am writing to request an internal review of Highways England Company Limited's handling of my FOI request 'Contractor Charge Comparison'.

No information has been provided and 20 days has passed.

Why does the request exceed the limit, over what period have you estimated the cost to exceed £450 and what period could be provided?
I am referring to third party damage to crown property claims works
The comparator is the charge for a service with the lowest being ‘1. Why was this not asked a month ago?
information based on just the initial attendance and repairs. Not administration.
Contractor is your appointed repairer
Staff, operatives, the people involved in the initial attendance and repairs.
Any vehicle.

We consider the disclose fee information exempt under Section 43 (commercial interests) of the Freedom of Information Act (FOIA), a similar request was made recently and the Public Interest Test (PIT) concluded that there are compelling arguments which support withholding the information which outweigh those supporting release. What do you mean by Defined Cost?

The definition of Defined Cost varies slightly from contract to contract, below is the definition from the Asset Support Contract in Area 10:

Defined Cost is:
• the amount of payments due to Subcontractors for work which is subcontracted without taking account of amounts deducted for
• payments to Others and
• the supply of equipment, supplies and services included in the charge for overhead costs incurred within the Working Areas in this contract and
• the cost of the components in Schedule 1 for other work

less
• the cost of preparing quotations for compensation events where the work affected forms part of the Lump Sum Duties and
• Disallowed Cost.

Can you help me with the terms you have used because I can't work out what you get.

For Contracts that have a threshold for Damage to Crown Property Claims the
requirement for below threshold claims is for the cost information to be captured in
aggregate and reported monthly on a cumulative basis. The format is generally total
aggregate costs for incidence response, third party damage and traffic management.
We also require the aggregate amount for the claims raised. We do not generally
hold incident specific costs

Can you give me an example to show aggregate cost information and cumulative data and the other data quoted and how it looks separated out.
