Contract information for A105 cycle lane construction.

Response to this request is long overdue. By law, under all circumstances, Enfield Council should have responded by now (details). You can complain by requesting an internal review.

Dear Enfield Council,

Please may I see the following information in connection with cycle lane construction on the A105 in your borough.

1. Unpriced details of the design contract with Jacobs. This will include a full schedule of work carried out under the design contract plus information on the form of payment for
these design services e.g. is the design fee fixed or calculated as a percentage of the cost of works? If the latter, I will also want to know whether this cost of works is a
pre-contract estimate or is it the final cost of the works? What was your required programme, if any, for carrying out the design works?

2. Complete unpriced call off documentation for the construction works with Ringway Jacobs, including full call off description by all parties to the contract. I also request
clarification on the type of contract that is formed by this call off. Is it a priced contract, a target contract or a cost-reimbursable form of contract and is it with or
without Bills of Quantities? If it is with quantities may I see an unpriced BOQ? If there are programme requirements may I also see these? If Ringway Jacobs has issued a letter of
acceptance to this call off, may I see a redacted copy?

3. What is the estimated cost of this call off or is there a projected call off total sum? Who prepared it and when? Is this cost estimate updated regularly? If so, may I have
details? Is there any contingency in the cost estimate or call off total sum?

Dear Enfield Council,

Your email to me dated 04/07/2017 15:59 admits to there being a Bill of Quantities existing within the LoHAC documentation but it is not within the documentation supplied to me under this FOI. May I please therefore have a copy, albeit late, including cover details of who prepared this document and when?
Moreover you stated in your response to my FOI that you was awaiting much of the information to be finalised even though at the time of your reply work on site was into the twelth month of what your council cabinet minuted as being a six month contract. Is it finalised yet because I still want to see it?

The internal review system does not seem to be working as I still do not have the information that I requested.
I conclude that requesting another internal review will only give LBE the excuse to delay releasing the information that I requested further.
I do however have two other FOI requests due by the 13th and I will decide on the appropriate next step based on the outcome of those requests.

The documents requested are owned by a third party (TfL) and are not London Borough of Enfield documents to release. Any request should be made direct to them.

We are waiting for this information to be finalised and as soon as we have received it we will forward it to you as appropriate.

Please note that the order for the A105 is part of the overall LoHAC contract and as such the responses below relate to that.

In order of the questions raised,
1)As per the OJEU notice, which is in the order of £2.6B
2)TfL in 2003.
3)Annual adjustments are made by TfL in accordance with the Highways Term Maintenance Indices (HTMI).
4)This will be held by TfL
5)These are made per projects when the call of contract is used.

This information was first requested on 5th April 2017 and the response of
19th May 2017 claimed that this information was awaiting finalisation.

Please find attached the response that was sent to you in June 2017.

We consider the above request to be a repeat request and it is therefore
exempt under section 14(2) of the Freedom of Information Act.  This
section states:

 

Where a public authority has previously complied with a request for
information which was made by any person, it is not obliged to comply with
a subsequent identical or substantially similar request from that person
unless a reasonable interval has elapsed between compliance with the
previous request and the making of the current request.
