I am writing to request an internal review of British Broadcasting Corporation's handling of my FOI request 'Contract between Cerego and BBC Bitesize'.

Ref: RFI20190362.

Whilst I respect that the BBC has the right to withhold specific information that would likely prejudice the commercial interests of the BBC and Cerego, I expected that any non-exempt information in the form of material from the minutes (as referred to in point 1) and the contract (as referred to in point 2) should not have been withheld, and I therefore ask you to review the decision not to disclose this information.

I refer you to point 34 of section 43 of the Freedom of Information Act, which states “it is also important for a public authority to consider each clause within a contract, rather than view the contract as a whole. Arguments about the burden this may create are not relevant under section 43.” As such, my expectation that clauses that do not contain commercially sensitive information are brought into the public realm, is in line with obligations placed on public organisations under the Freedom of Information Act.

Similarly, I expect that minutes from any meetings where the procurement of Cerego was discussed are provided. If you believe these minutes contain commercially sensitive information, which allows the exemption from disclosure under section 43(2) to apply, I would expect a full explanation of why this is the case.

Under the Freedom of Information Act, at a minimum, we have the right to information (listed below) which will allow the public to have an understanding of the procurement process, so that trust and the spirit of openness - which are very much in the public interest - can be maintained.

-The number of meetings in which the procurement of Cerego was discussed
-The dates of these meetings
-The attendees of these meetings, and their roles
-The agendas for these meetings
-A summary of any discussions and decisions that took place at these meetings, which do not divulge commercially sensitive information

This information will not affect the confidence companies have in dealing commercially with the BBC or sharing commercially sensitive information because any such sensitive information can be removed. The information requested will not adversely affect the BBC or Cerego as no information that confers competitive advantage would have been shared.
