Dear Herefordshire Council,

Please confirm if any Director of Herefordshire Council held a Directors post with an external Company in 2012 whilst in a full time Directors post at Herefordshire Council. If yes, please also supply the name of that Company. I am specifically interested in the period January 2011 through to September 2012.

If the answer to the above is yes, please confirm what work if any was carried out by that Company for Herefordshire Council.

Please confirm if Connor Consulting have done any Consultancy work for Herefordshire Council and the cost for any services provided. Please also detail the nature of that work and the Department for which the work was carried out.

Please can you disclose the documentation and processes, to show how the Council appointed Ciber UK as their chosen provider for Cutomer Services CRM system. For example did the final decision go before a committee?

Please supply detailed accounts for all money paid to Ciber UK to date and list what each cost was for.

Please confirm the total expected costs in relation to this software for the full term of this contract from commencing the contract to the end of the contract term.

What on-going level of support was included in the contract from Ciber UK?

If additional costs were incurred that did not form part of the contract, what were/are the additional costs for?

Can you please detail any relationships between Council employees and staff from Ciber UK I.e. any members of staff involved in the CRM project prior to the award of the contract also how you became aware of Cibers services which led to the award. Please include Consultants working for the Council when the award was made.

If an issue arises with the software is there locally based support living in Herefordshire, for example support staff, technicians or consultants working for ciber?

Please confirm this software is fit for purpose and fully interacts with all your back office systems, I.e Amey Hereford.

Are there any on going issues with the compatibility or stability of this software.

Dear Freedom Of Information (Council),

Please confirm the Council was unaware the Lead Consultant working for Ciber UK identified in the following news release lives in Hereford. The public are entitled to know how a 1.5 million pound contract advertised Nationally is awarded to a company with a consultant living in Hereford. This has to be more than coincidence? Please explain how this coincidence occurred? Particularly since a previous ICT contract award culminated in the Crookall Report?

Can you please also provide a copy of the Crookall Report I am unable to find the FULL report on your website.

Dear Freedom Of Information (Council),

Please pass this request to the person who conducts your internal reviews. I do not see this as a new request since I believe the original response was misleading. I am happy to wait for the Crookall Report since there was no reference to it in the original request.

My original request asks if there was support living in Herefordshire I.e. Ciber Consultant. I find it difficult to believe that you would not know the lead Consultant mentioned in the article is based in Herefordshire since I believe there are connections to members of staff working on this project. Members of staff would therefore have known the Lead Consultant lived in Hereford.

My request for the Crookall Report is to compare similarities with the award of this contact and the previous scandal contained in the Crookall Report.

Public authorities have an obligation to respond to FOI requests openly and honestly. You have a duty to check the information you supply is accurate.

I have spoken with the ICO and they have referred me to the following information in relation to the FOI Act.

You may be breaching the Freedom of Information Act if you do any of the following:

fail to respond adequately to a request for information;
fail to adopt the model publication scheme, or do not publish the correct information; or
deliberately destroy, hide or alter requested information to prevent it being released.

This last point is the only criminal offence in the Act that individuals and public authorities can be charged with.

Other breaches of the Act are unlawful but not criminal. The Information Commissioner’s Office (ICO) cannot fine you if you fail to comply with the Act, nor can we require you to pay compensation to anyone for breaches of the Act. However, you should correct any mistakes as soon as you are aware of them.

Should I feel it necessary to complain to the ICO then all the documentation you supplied will be looked at so please check the accuracy of this information. I strongly believe there are inaccuracies in that information. As stated it is a criminal offence to deliberately hide information.

For example example I have conducted further research and I believe it is common knowledge that the CRM system supplied by Ciber is not fully compliant/does not interact with your back office systems.

The information supplied by the ICO states you should correct any mistakes as soon as you become aware of them. I am therefore exercising my right to an internal review of my request to give you an opportunity to correct your response.
