Dear North Yorkshire County Council,

Please can you provide copies of all emails/memos/minutes of meetings that pertain to discussions about the effect of the Department of Transport's revised guidance on section 19 permits and their applicability to scheduled passenger services.

I would in particular like to see copies of documents that relate to the decision taken last week that NYCC fleet would operate bus route 426 between Cawood and York.

I am writing further to your request under Freedom of Information, case
reference N2908.


The information we hold relating
to your request falls into three categories. 


Firstly, we hold
some information that is not exempt from disclosure and I have attached
that for your information.

Secondly some information is exempted from disclosure under Section 42 –
“legal professional privilege” and the Council will therefore not provide


Thirdly, in the reasonable opinion of the Council’s qualified person, Mr B
Khan, Assistant Chief Executive, Legal and Democratic Services, other
information that the Council holds is exempted from disclosure under
Section 36 “prejudice to the effective conduct of public affairs”.
Further, the public interest in disclosure of this information is
outweighed by the public interest in maintaining the exemption. The
Council will therefore not provide it.


If you wish to make an appeal in respect of this refusal, the procedure to
do so is described in the attached Appeals Procedure document.
