Dear NHS Herts Valleys Clinical Commissioning Group,

1. Please state the number of individuals in receipt of full CC funding in the FY 2014, 2015, 2016, 2017.

2. Please state the number of individuals in receipt of partial/nursing contribution in the FY 2014, 2015, 2016, 2017.

3. Please state the number of individuals receiving full funding for residential/nursing home placements in the FY 2014, 2015, 2016, 2017.

4. Please list the residential companies that were contracted for full funding placements in the FY 2014, 2015, 2016, 2017.

5. Please state the number of 6 weeks placement reviews that were not carried out in the 6 week deadline in the FY2014, 2015, 2016, 2017.

6. Please state the number of annual reviews that were not carried as due in the FY 2014, 2015, 2016, 2017.

7. Please state when Herts Valley carried out Quality and Procurement checks on residential providers that is funds in the FY 2014, 2015, 2016, 2017.

8. Please confirm the number of placement in homes owned or run by TLC Group in the FY 2014, 2015, 2016, 2017.

9. Please confirm the policy timeframe for carrying out Q & P checks for individual in placement.

10. Please state for each FY 2014 - 2017 the number of overdue Q & P's for residential placements.

11. Please state Herts Valley policy for assisting resident and their families with complaints and provision issues within residential placements (then explain why you actually do nothing!).

12. Please clarify why you continually fail to enact the guidelines in the NF for assisting complaints from funded residents and their families.

13. Please clarify if Herts Valley communicates and compares with other CCGs in respect of Q & P at residential placements.

14. Please state the number of transfers of funding to LA that were delayed due "administrative errors" or the more honest "we forgot/couldn't be bothered" ( to include Mrs Dawn Courtney) in the FY 2014, 2015, 2016, 2017.

15. Please state the dates and reason for meetings between HV and Carlton Court "care" home in the FY 2016 & 2017.

16. Please clarify if there is any policy for financial reimbursement or penalty against failing providers or for breach of contract. - if so when and who was this enacted against.

17. Please clarify if the CCG continues to pay residential fees to commercial placements whilst individuals are under hospital care for Dehydration, "falls" and/or medication issues.

18. Please state what monitoring and reporting the CCG/CC undertakes when a fully or partial funded individual is admitted to hospital. (i.e: are the providers required to report to funders and time frame to report).

Please advise if it is prefer that this request is repeated financial year by financial year in order to avoid response delivery issues.

Please note that reference to FY 2017 (although incomplete) should cover data for the 3/4 (December 2017).

Dear FOI, Hvccg (NHS HERTS VALLEYS CCG),

Thank you for your response but the information request is not individual respective.

You are require to provide answers to all 18 questions - which relate to policy and statistic information. It is a valid query to assess the competence, consistency and performance of a state funded provision, who also administers state funds.

Query 14 is a general question (with an example) concerning "errors".

Query 15 is not individual specific (but relates to contact with a provider.

Please let me know if you wish the request to be resubmit financial year by financial year.

It is difficult to understand a request for statistic information (18!) could be interrupted as case specific.

The data may used as cross referencing or referred to in complaints or civil proceedings, but this does not prohibit the provision of already audited generalised information.

Dear FOI, Hvccg (NHS HERTS VALLEYS CCG),

I apologise for offering such an easy get out ... and using the word residential when clearly being address to the CCG I should have been explicit and replaced with nursing or just commercial "care" home. I was wrongly and inadvertently assumptive.

Please advise should I re word the original FOI request with diligence and resubmit or will you address the queries in which you have responded taking "residential" to mean LA funded placements.

I look forward to your reply. I am very interested to compare quality assurance checks and procurement from Herts Valley in comparison to other funders.

Dear FOI, Hvccg (NHS HERTS VALLEYS CCG),

I will re-formulate this request to cover the missing information.

Of the authorities (groomers!) asked - Herts Valley was the only authority to be obstructive!

That's no surprise.

further requests include:
role and appointment of the tea boy to Development Manager
role and appointment of current "governance" manager
procedures and reporting process in light of lost data and data protection breaches
policy for addressing provider failings
provider contracts
Reviews process, outcomes, monitoring ….

I have asked the Secretary of State for Care to clarify legislative, regulatory and accountability issues. - it is clear that the current "dump and ignore" policy is unlawful and neglect.
