With regard to your request for information under the Freedom of
Information Act 2000 received on 26^th April 2009, I have pleasure in
enclosing our response.
We attach our response (letter dated 29 June 1993) to a consultation
exercise by the Department of the Environment to review UK wildlife sales
controls and amendments to Schedule 4 of the Wildlife and Countryside Act
1981 concerning bird registration and ringing. This review led to two
Statutory Instruments being laid before Parliament which came into force
on 24^th May 1994: SI No.1151 The Wildlife and Countryside Act 1981
(Variation of Schedule 4) Order 1994, and SI No.1152 The Wildlife and
Countryside (Registration and Ringing of Certain Captive
Birds)(Amendment) Regulations 1994. Our response to this consultation
exercise is the only record we can find that has specific reference to
`put(ting) hybrid falcons on the Wildlife and Countryside Act'.
SI No. 1151 extended the provisions of Schedule 4 to cover `any bird one
of whose parents or other lineal ancestor was a bird of a kind specified
in the foregoing provisions of this Schedule'. According to our records
JNCC were not specifically consulted on the inclusion of this sentence,
however you will note on page 3 of our response to the original
consultation that we state that `hybrids and species closely resembling
native species should remain subject to control'.
Prior to these Statutory Instruments coming into force all Falconidae had
been listed on Schedule 4 of the WCA 1981 and therefore the provisions of
Schedule 4 would have applied to all falcons whether hybrids or not. We
do not hold any other records which indicate that JNCC was consulted on
the inclusion of hybrids on the WCA 1981 prior to the consultation
exercise in 1993.

It is impossible to to believe that what you have disclosed is all that you have on such an important area in relation to hybrids.
Could you also expand on what was said about keeping hybrid birds of prey on a list that needs to be registered, in a JNCC letter dated 1993? Could you also clearly expand what JNCC means by keeping Hybrids under control in 1993?
Why do the letters have corrections on? There must be letters that were the final drafts.

Please accept our apologies for the delay in replying to your email of
24^th May 2009.
You asked for an explanation in this email relating to the information and
advice we provided previously. This response provides this explanation and
we hope that this meets your requirements.
The correspondence you requested from us dates from a period now 15-16
years ago. We have copied all the documents to you from that time that
seemed to meet the parameters in your request. I am afraid that even if
more documents existed at the time we did not retain these as we do not
keep a copy of every document on every topic for ever. Accordingly for
clarification we advise you that the part of the information you requested
that we do not hold falls under the exception under regulation 12 (4) (a)
of the Environment Information Regulations - The public authority `does
not hold that information when an applicant's request is received' This
situation has not changed since.
Our interpretation of the comments that you refer to in the letter written
in 1993 are that as all birds within the Family Falconidae were required
to be registered then, de facto, all hybrid falcons required registration
also. However, following the 1993 review when only a number of Falco
species were retained on the Schedule, it was clearly necessary then to
specifically include such hybrids. The JNCC comments were not focused
solely on falcons of course, other species on the Schedule also hybridise
with other non-listed taxa.
We do not know why the letter you refer to has hand-written corrections
on. To the best of our knowledge it is our copy of the letter that was
sent to DoE at the time; we do not have any other copy. However, as we
state above, this correspondence dates from 15-16 years ago and we cannot
say why such hand-written editing is on the copy.
