Consultation Documents - accountability for their accuracy

The request was successful.

Dear Scottish Government,

The document ‘Review of Part 1 of the Children (Scotland) Act 1995 and creation of a Family Justice Modernisation Strategy A Consultation’ published in May 2018 in ‘Part 4: Contact’ states the following:

4.07 The contact centres offer a mixture of supported contact and supervised contact. Supported contact is where there is no significant risk to the child and therefore contact centres only record that the contact took place and not details of how it went. Supervised contact is where contact takes place in the constant presence of an independent person who observes and ensures the safety of those involved.

A Defence Production (a Data Protection Act 2018 Subject Access Request from Family Mediation Central Scotland) in a prosecution under Section 39 of the Criminal Justice & Licensing (Scotland) Act 2010 (together with an additional narrative) at Stirling Sheriff Court shows that this information in the Consultation document is inaccurate. Supported Contact does involve the Contact Centre recording copious notes on the conduct of the "supported" parent.

What level of Scottish Government authority (i.e. the staff paygrade/Job Title) is accountable for ensuring the accuracy of information published in Consultation documents?

Yours faithfully,

SJA Grove
