I am currently looking into performance of public sector
construction projects for a study that I am undertaking. Please can
you give me a list of all construction projects undertaken with the
following information:

Name/ description of project
Tier 1 Contractor
location of project
Contract form
Framework Name if Applicable
Contract price for construction
Final price for construction
Construction start date
Initial construction completion date
Actual construction completion date

I would also like this request to be considered under the
Environmental Information Regulations 2004.

Thank you for your response. I made requests to two very different organisations and as such I quite reasonably expected them to be treated as such. I am sure that the DIO holds most of this information on its projects database and as such is in a position to release a significant amount to me with the miminum of time expended.

Therefore, I am adjusting my request to ask for the relevant fields in the database to be dowloaded and forwarded on to me.

Dear Ms Lovett,
Thank you for your e-mail. Army sites and many of the Navy's are managed on the Services' behalf by the Defence Infrastructure Organisation (DIO). Your requests for details of construction projects were therefore passed to the DIO to respond to.

The DIO does maintain a central record of various construction contracts and it is currently exploring what information may be provided to you within the appropriate limit of the FOI Act. We will write you again with this information.

I am surprised that an administrative error is being quoted, because I sent requests through here and asked for an update through the central MoD information service too. It is only now that I have involved the Information Commissioner that you have responded.

I would like to highlight that it is nearly 6 months since you last made a response to my request so I think that I am now 3 sets of 60 days worth of requests in the bag.

Dear Mike,

Please Take this as my request for an(other) internal review. I am very disappointed that in the current political environment, where the Government had promised transparency and even mandated the requirement in Policy Procurement Note 2/11 and other policy documents, that the MoD feels that it should not comply.

I am asking for very high level information, which on projects that have been completed, within a framework situation, where there is no competition. I still see this as part of the case that I referred to the Information Commissioner and as such if this is not resolved to my satisfaction and quickly I will be forced to update them on my lack of progress.

As I have said previously I am happy for correspondence to be sent to me directly and not published on here. I will also be sending this request via my personal email address to prevent the chances of another 'administrative error' occurring.

We acknowledge receipt of your email received on 11 August 2013 in which
you applied for an internal review of your request for information under
the FOIA (our references: 10-01-2013-105426-005 and
14-01-2013-160542-003).

 

The Department's target for completing internal reviews is 20 working days
and we therefore aim to complete the review and respond to you by 13
September 2013. While we are working hard to achieve this, in the
interests of providing you with a realistic indication of when you should
expect a response, I should advise that the majority are currently taking
between 20 and 40 working days to complete.

 

The review will involve a full, independent reconsideration of the
handling of the case as well as the final decision.

The meaning of your last message is not entirely clear. On 11 August
2013 you requested an internal review but on 27 August 2013 you say that
the matter "is still part of a complaint with the Information
Commissioner, so is not part of a new request for an internal review".

We can cancel your request for a new internal review and will stand
ready to assist the Information Commissioner in whatever enquiries he
wishes to make to MOD in the course of his investigation.

If you check the correspondence you will see that I asked for an internal review on this request months ago, I failed to receive an answer and referred the case to the Information Commissioner, who wrote to the MoD and spurred it back into action.

This case is still a live case with the Information Commissioner and as such I would appreciate the MoD moving rather more quickly than 20 days, since I really have no desire to keep facilitating the delays the DIO have been creating for the last 8 months.
