Dear Cumbria County Council,
I make this request under the Environmental Information Regulations 2004 and the Freedom of Information Act 2000. Please supply the response under whichever act results in the disclosure of the most information. In the event that the information disclosure under EIR and FOI would be the same, please disclose the information under EIR.
Please provide copies of all communications (including, but not limited, to emails with any attachments and minutes of meetings) between Cumbria County Council and Cumbria Waste Management Limited (including agents, partners and any other company or individual acting for, or with, Cumbria Waste Management Limited) regarding the construction and operation of a building at Hespin Wood whose purpose(s) includes the processing of waste to produce Refuse Derived Fuel. The information disclosed should include all correspondence that reference one or both of planning applications 1/18/9006 and 1/21/9004. If it is necessary to limit the search to a specific period of time, please include all relevant information since 1 January 2017. Please include all communications that have taken place with planning officers regarding this development. Please also include any other communications that may have taken place regarding this development, e.g. at management/director level.
Information already available on planning.cumbria.gov.uk under 1/18/9006, 1/21/9004 and 1/2017_screening2 need not be included, but please include covering emails/letters if these are not available to the public on planning.cumbria.gov.uk.

Thank you for your request for information regarding Waste Management,
which was received on 12/09/2022.
The council aims to provide you with the information within the statutory
timescale of 20 working days in this case the date is 07/10/2022.
Subject to the information not being exempt or containing any references
to third parties.
The council will, as a matter of routine make information available in
electronic format. Where it is not practical to do this information will
be provided in hard copy (paper). If information is required in
alternative formats e.g. language, audio, large print, etc., please
indicate this as soon as possible so the council can consider your
request.
The Environmental Information Regulations 2004 define a number of
exemptions/exceptions which may prevent information being released to you
automatically. The council will make an assessment about the application
of any exemptions/exceptions and issue you with a decision letter, which
will include details of your right to appeal.
If the information you request contains reference to a third party the
council will consult with them prior to making a decision about the
release of information.
In accordance with the council's Charging Policy a fee may be charged for
supplying information. If a fee is payable you will be issued with a fees
notice. The applicable fee must be paid in full before the information is
processed and released. The statutory time limit for responses is
suspended until the council has received and processed your payment. If
payment is not received within three months of issuing the fees notice
your request will be closed.

This request is overdue. The information should have been provided by the Council. The delay has prevented me from having access to information for my representation to the development control and regulation committee regarding planning application 1/21/9004.

Dear D Mudge,
I am writing to inform you that I am extending the timescale for the above
request for a further 20 working days from the current deadline date (7^th
October) taking us to 4^th November 2022.
“Regulation 7(1)(3) – requirement to notify the requester that the
authority needs an extension of time to deal with a request which is
complex or voluminous.”
The reason for this extension is due to the volume of work. I have
received an extremely large amount of separate documents from the service,
each of which need reviewing and any necessary redactions made. I estimate
each document will take anywhere between 2-20 minutes to review / redact
which is multiple days’ worth of work.

I apologise for the delays you have experienced with this request.
Unfortunately, we are unable to supply you with the information at this time. This request has taken longer than anticipated.
Despite having a high case load, I have personally prioritised your request and have spent several hours working on it each day, trying to get this completed within the stated timescale.
I am still reviewing the files and once I have completed this, I will need to undertake a third party consultation. We give the third parties 1 week to review the request and get back to us with any objections etc. As such, this will be delayed by more than 1 week. Again, I can only apologise.
I'm afraid there is nothing further I can do to speed this up and so if you are dissatisfied with this, you will need to submit a complaint to the Information Commissioners Office.
