I refer to your request for information which we received today.

 

In considering your request for information, I have reviewed the records
which contain applicable information. I have also considered the following
legislation:

2016 (‘the 2016 Act’)

•                    The Freedom of Information Act 2000 (‘FOIA 2000’)

Your request for Information has been treated as a request for information
in accordance with section 1(1) The Freedom of Information Act 2000.

You requested the following information:

 

“How does the Ombudsman collect information from PSNI when there is no
case outstanding with the said Ombudsman”

 

My Response

 

The Ombudsman's jurisdiction is contained within the Public Services
Ombudsman (Northern Ireland) Act 2016 ("the 2016 Act)"). This can be found

NIPSO can investigate complaints from an aggrieved in accordance with the
2016 Act.  NIPSO has power to seek evidence by virtue of section 31 "For
the purposes of an investigation, the Ombudsman may require the listed
authority being investigated and any of the persons ....."

 

The Police Service of Northern Ireland ("the PSNI") is not a listed 
authority under the 2016 Act. The PSNI is supervised in respect of
complaints by the Office of the Police Ombudsman for Northern Ireland
("OPONI"). This is a different organisation from NIPSO and their website

NIPSO does not have powers to request information otherwise than in the
course of an investigation.

Dear NIPSO Legal Services,

Indeed. So why did the legal department get the information re 23 December and 7 January 2022, when there was no investigation ongoing. In fact, there was no investigation at all. This will be raised as a new request.
