An updated register is due to be published in April, as such s22 FOIA
applies as this information is held with a view to its publication. We
have considered whether it would be in the public interest for us to
provide you with the information ahead of publication in that disclosure

the public interest in the PHSO keeping to its timetable for disclosure

 

Given that the information is to be published within a short period of
time we have concluded that it is reasonable to withhold the information
from disclosure until its publication date.

I was informed as part of that request that the Register would be updated in April and a link made available on the website. I prompted the Ombudsman to provide the link but none was forthcoming. We have now passed through April and I have been given no access to the updated register in compliance with my request.

I would be grateful if you could look into this matter for me as this document is of key public interest.

We have searched records back to 2016 and there have been 4 instances
recorded of perceived conflict of interest. These were:

 

•        Partner works for PHSO

•        Family member being a freemason

•        Acquaintance being a health correspondent for a news broadcaster

•        Family member having an ongoing case with land registry

 

If you believe we have made an error in the way I have processed your
information request, it is open to you to request an internal review.  You
can do this by writing to us by post or by email to

nature of the issue is and we can consider the matter further. Beyond

Thank you for your speedy response. As you have looked at your records back to 2016 I was expecting there to be a conflict of interest statement for Elisabeth Jane Spence who is Director of St Wilfrid's Hospice (South Coast) while simultaneously working as an investigator for the Parliamentary and Health Service Ombudsman. This would seem to be more than a 'perceived conflict of interest' and should surely have been recorded by PHSO in order to prevent Ms Spence from investigating her own organisation. Can you please explain this oversight?

I write in response to your email of 24 July 2018 regarding your request
for information made under the Freedom of Information Act 2000 to the
Parliamentary and Health Service Ombudsman (PHSO).

 

Firstly, I have clarified this matter for you and I understand that the
list provided to you as part of your previous request was specific to PHSO
staff only.

 

Any associates/investigators working for the PHSO were not direct
employees but generally self-employed. These roles were hired by the
individual department or manager that required them and any
contracts/terms and conditions were managed by them directly. These roles
were predominantly within our Operations department including clinical
advice. Individuals carrying out this role would have been expected to
declare any conflict of interest at the outset and throughout the course
of working for PHSO if any changes occurred.

 

It is worth noting however that a declaration of conflict of interest for
a PHSO staff member is separate to a conflict of interest assurance that
would be sought from an associate which includes our current clinical
advisors. Our consideration of conflict of interest for clinical advice is
more specific and ongoing since every piece of advice on every case
requires a signed declaration to confirm that no conflict of interest on
that particular case applies. Therefore advice would not be completed by
an advisor who works or has worked at the body complaint about.

 

With regards to historically recording conflict of interests for
associates/investigators, we only hold limited information. As part of
your request I have been able to locate some additional information which
is a record from our Operations department and this information is only

Tut tut.

IF only the PHSO had applied Section 16, and offered advice and assistance to clarify your request and so give you any conflict of interest declarations ......Instead of time wasting public money.

Section 16
Public authorities have a DUTY to provide ADVICE and ASSISTANCE to individuals making requests for information under FOIA.

Public authorities should provide advice and assistance to an applicant in the following circumstances:
 to clarify unclear requests;
 to help to provide the information requested in an
acceptable format;
 to narrow responses which exceed the cost limit (section 12);
 when they have refused to provide the information
because it is accessible by other means (section 21) or there is an intention to publish it in the future (section 22); and
 when their request is transferred to another public authority because the information is held by it, and not by the public authority it was addressed to.

There is such a lot of 'misinformation' in the responses to this very simple FOI request that it is now difficutl to see the wood for the trees. Intentional?

This was the original question:

Please can you provide me with your current policy on recording conflicts of interest for staff at PHSO?

Please can you provide me with links to your conflict of interest register for the last five years?

You have provided links to your current policy but it would appear that PHSO is not following their own guidelines. You have not provided me with links to your conflict of interest register for the last five years. Instead, you have provided a conflict of interest register which applies only to board members and some senior staff for the current year. Can I please see the links to this register for the last five years as requested?

Your policy makes it clear that all staff are required to declare an actual or perceived conflict of interest.

2.
This policy covers PHSO employees, including those on either permanent or fixed–
term contracts and those on secondment from other organisations.

3.
Temporary agency workers, contractors, consultants and advisers working at
PHSO, in line with the principles and guidelines laid out in this policy, are
required to declare any actual, or perceived, conflict of interest pertaining to the
work they have been engaged to undertake.

However, only the board members register is made publicly available.

10.1 For governance reasons Advisory Board and Audit Committee members are asked
once a year to confirm that their potential conflicts of interests have not
changed.
10.2 The Register of Interests for Senior Staff is included in the PHSO publication
scheme and is, therefore, openly available. The section for all other employees
is not published. However, PHSO reserves the right to disclose interests on
request or as necessary, subject to the principles of the Data Protection Act
1998.

Your policy also states;

 PHSO’s effectiveness depends on its reputation for being open, fair and
impartial and it is essential that we are scrupulous in maintaining this
reputation;

It is essential that you are scrupulous - yet it would appear that a rather ad-hoc arrangement has taken place in regard to recording a conflict of interest which affects investigatory staff at PHSO. No record can be found for Elisabeth Jane Spence who is Director of St Wilfrid's Hospice (South Coast) and currently a caseworker at PHSO. No record - in all the time she has performed these dual functions!

In 2014/15 - for just that one year - some records remain for caseworkers. Within this information, we learn that it is quite acceptable to be both a PHSO caseworker and an NHS complaint handler at the same time.

I write in response to your email of 22 August 2018 in which you request
an Internal Review of our response to your request for information. I have
reconsidered the correspondence and our response to you.

 

Timeliness of Response

 

The response to your request was provided within the 20 working days
stipulated by section 10(1) of the Freedom of Information Act 2000.

 

Review of your request of 24 July 2018 (R0000126)

 

You requested the following information -

 

‘Thank you for your speedy response.  As you have looked at your records
back to 2016 I was expecting there to be a conflict of interest statement
for Elisabeth Jane Spence who is Director of St Wilfrid's Hospice (South
Coast) while simultaneously working as an investigator for the
Parliamentary and Health Service Ombudsman. This would seem to be more
than a 'perceived conflict of interest' and should surely have been
recorded by PHSO in order to prevent Ms Spence from investigating her own
organisation.  Can you please explain this oversight?’

 

In respect of our response to the above request, we provided recorded
information where held which was relevant to the information specifically
requested. In our response we also provided clarification and an
explanation of the information provided in a previous response. Assistance
was also given in accordance with our duty to advise and assist under
section 16 of the Freedom of Information Act 2000.

 

I acknowledge however that your email of 24 July 2018 relates to a number
of similar requests made relating to the PHSO ‘conflict of interest
register’, specifically, your request of 21 February 2018 under reference
number FDC-275079.

 

‘Please can you provide me with links to your conflict of interest
register for the last five years?’

 

You have further have asked in your email of 22 August 2018 - ‘Can I
please see the links to this register for the last five years as
requested?’

 

We explained in our response of 11 July 2018 (R0000069) PHSO staff do
‘have the facility to report any perceived conflicts of interest
internally through HR’. Additionally, in our response of 24 July 2018
(R0000109) we searched our records back to 2016 and provided information
on four instances of perceived conflict of interest which has been
recorded by the HR department.

 

These were:

 

• Partner works for PHSO

• Family member being a freemason

• Acquaintance being a health correspondent for a news broadcaster

• Family member having an ongoing case with land registry

 

In response to your request for an internal review we have conducted a
further search for information between 2016 and 2013 and found that there
have been six instances of perceived conflict of interest recorded.

 

These were:

 

•        PHSO staff member and their Partner have previously worked for
the JCP

•        Family member is a Custody Officer for G4S/UK Borders Agency

•        Previously worked for UK Border Agency which falls within PHSO
Jurisdiction

•        Has an honorary contract at two NHS Hospitals.

•        Relative works as a specialist training doctor for an NHS Trust

•        Previously worked for the Information Commissioner's Office.
Additionally, a relative also works at Information Commissioner’s Office.

 

Conclusion

 

For the reasons set out above I partly uphold your complaint as further
information was held by PHSO within the scope of your request and we
failed to provide this information in our previous correspondence with
you. The original search of our HR records was to 2016 and not for the 5
years as requested.

 

No further information is held.

 

If you remain unhappy with our response, it is open to you to complain to
