Dear Della Reynolds,

RE: Your Information Request – FDC-275079

Thank you for your email of 21 February 2018 in which you requested
information held by the Parliamentary and Health Service Ombudsman (PHSO).
Your request has been processed in accordance with Freedom of Information
Act 2000 (FOIA).

You requested the following information:

‘Please can you provide me with your current policy on recording conflicts
of interest for staff at PHSO?

Please can you provide me with links to your conflict of interest register
for the last five years?’

We can confirm the PHSO’s Conflict of Interest Policy is available on the
PHSO website and therefore exempt under s21 FOIA as it is reasonably
accessible via the below link. To assist we have also attached a copy of
the Policy to this email:

[1]https://www.ombudsman.org.uk/sites/defau...

Additionally, we have also attached a copy of the PHSO’s Conflict of
Interest Guidance which goes in to further detail about the process for
reporting a conflict of interest.

In relation to your request for a link to our conflict of interest
register for the last five years.

The board register of declarations of interest is exempt under s21 FOIA as
it is reasonably accessible via the below link

[2]https://www.ombudsman.org.uk/sites/defau...

An updated register is due to be published in April, as such s22 FOIA
applies as this information is held with a view to its publication. We
have considered whether it would be in the public interest for us to
provide you with the information ahead of publication in that disclosure
would improve transparency of PHSO however this must be balanced against
the public interest in the PHSO keeping to its timetable for disclosure

Given that the information is to be published within a short period of
time we have concluded that it is reasonable to withhold the information
from disclosure until its publication date.

We hope you have found this email helpful. If you believe we have made an
error in the way we have processed your information request, you can
request an internal review. To do this please email
[3][Parliamentary and Health Service Ombudsman request email] and included details of your
concerns so we can consider them further.

If you remain dissatisfied following the outcome of the internal review,
you would have the option to complain directly to the Information
Commissioner’s Office. Details of how to do this can be found on their
website [4]www.ico.org.uk.

Yours sincerely,

Dear InformationRights,

Why are you treating this as a new request? I was informed that the information I requested would be published in April. It is now the 16th April and I am simply completing this request by asking for a link to the now (presumably) published risk register. If it is not yet published please state this a.s.a.p and give a date for publication. That should not take 20 working days.

Yours sincerely,

Della Reynolds

Dear Parliamentary and Health Service Ombudsman,

This request is now long overdue. We are close to the end of April and no link to the Conflict of Interests Register. If none is received by the end of the month then I will report this issue to ICO.

Yours faithfully,

Della Reynolds.

Dear Parliamentary and Health Service Ombudsman,

I have reported this matter to ICO.

Dear Casework@ICO

I wish to report that the Parliamentary and Health Service Ombudsman has failed to provide their ‘Conflict of Interests Register’ following a request to see the same presented in February 2018. I was informed as part of that request that the Register would be updated in April and a link made available on the website. I prompted the Ombudsman to provide the link but none was forthcoming. We have now passed through April and I have been given no access to the updated register in compliance with my request.

I would be grateful if you could look into this matter for me as this document is of key public interest.

Many thanks

Della Reynolds

Yours faithfully,

Dear Della Reynolds,

RE: Your Information Request – FDN-275176

Thank you for your emails of 11, 16, 24 April and 3 May 2018 in which you
requested information held by the Parliamentary and Health Service
Ombudsman (PHSO). Your request has been processed in accordance with
Freedom of Information Act 2000.

You requested the following information:

‘It is now April. Can you send me the link to the updated register and
then I can close this request?’

In our response of 21 March 2018 we confirmed an updated Conflict of
Interest Register was due to be published in April 2018. At the time of
your request however we were unable to confirm which day in April this
would be. We can now confirm that the Register was published on the PHSO
website, on 2 May 2018. We apologies for the short delay and for any
inconvenience this may have caused you.

As the updated Conflict of Interest Register is now available on the PHSO
website it is therefore exempt under Section 21 of the Freedom of
Information Act 2000, as it is reasonably accessible via the below link:

[1]https://www.ombudsman.org.uk/sites/defau...

We hope you have found this email helpful. If you believe we have made an
error in the way we have processed your information request, you can
request an internal review. To do this please email
[2][Parliamentary and Health Service Ombudsman request email] and included details of your
concerns so we can consider them further.

If you remain dissatisfied following the outcome of the internal review,
you would have the option to complain directly to the Information
Commissioner’s Office. Details of how to do this can be found on their
website [3]www.ico.org.uk.
