Dear Sir or Madam,

I work in Social Care and am interested in the confidentiality
procedures as regards Lancashire County Council. I note that
Lancashire County Council’s discipline hearings there have been 22
disciplinary cases at County Hall in the past 12 months. One case
involved a breach of the code of conduct in not maintaining
confidentiality.

Please treat this as a request under the Freedom of Information Act
2000.

I am interested in the obligations of the County Council to service
user confidentiality.

Can you please send me any policies/procedures applicable to Social
Care workers and confidentiality?

Are Social Care workers under a legal obligation to always respect
service user confidentiality unless there are good reasons to not
do so?

What are the reasons when obligations of confidentiality can be
ignored?

Are Social Care workers subject to a Code of Conduct governing
their obligations to service user confidentiality?

Please provide this Code of Conduct.

Is there any kind of employee handbook or confidentiality policy
that Social Care workers have to sign?

Please provide a copy of that employee handbook (or relevant
page/s) or the confidentiality policy document.

Further to your email dated 27^th February 2009, in which you request the
disclosure of information under the provisions of the above Act, we are
now in a position to respond.

1. Can you please send me any policies/procedures applicable to
Social Care workers and confidentiality?

Please see the `GSCC Codes of Practice' and `County Council Code of
Conduct' attachments which detail the information you have requested.

2. Are Social Care workers under a legal obligation to always
respect service user confidentiality unless there are good reasons to not
do so? What are the reasons when obligations of confidentiality can be
ignored?

Social Care Workers are always under a legal obligation to respect service
user confidentiality. The only circumstance where this would not apply
would be in the case of a Child Protection matter.

3. Are Social Care workers subject to a Code of Conduct governing
their obligations to service user confidentiality? Please provide this
Code of Conduct.

Social Care Workers are subject to a code of conduct governing their
obligations to service user confidentiality. Please see the attachment
`GSCC Code of Practice'

4. Is there any kind of employee handbook or confidentiality policy
that Social Care workers have to sign? Please provide a copy of that
employee handbook (or relevant page/s) or the confidentiality policy
document.

We can confirm that Social Care Workers and all Lancashire County Council
employees have to sign a Data Protection Act statement (please see
attached). All employees are also made aware that they have to maintain
confidentiality when handling data, as it is stated in their contract (an
extract of this is attached).
