Dear Mr Taylor

Please do acquire the information that I have requested from you, on my behalf, from Yorkshire Water.

I request the specific location and dimensions of the concrete and metal sewage tank, built underneath Endcliffe Park recreation ground.

I also request the details of how SCC plans to prevent the escape of sewage from this tank and from polluting the surrounding park, with its intended proposal to flood these grounds.

Yours sincerely,
Dr Shetty MRCVS

FOI, Sheffield City Council

Dear Dr Shetty,

In regard to your request for the Council to request information from Yorkshire Water there is no obligation for the Council to complete such activity under the Freedom of Information Act. As noted in our initial response to you: "The sewage tank you make reference to in your request is owned by Yorkshire Water, details of how to approach them for information can be found at: https://www.yorkshirewater.com/about-us/... This confirmation of the route to access the information requested was in accordance with our Section 16 duty to assist a requestor and it is for you to decide whether to proceed with making a request to this third party organisation.

In respect to the plans to prevent the escape of sewage from this tank and from polluting the surrounding park, with its intended proposal to flood these grounds: this is covered in the internal review response and we will not be revisiting this again. You have been provided with a link to current plans and consultation documents and it has been confirmed that review of the provision will be made further on in the development of the plan. There is no further information relevant for disclosure.

You of course retain the right to approach the Information Commissioner's Officer if you are unhappy with the handling of this case; but as this internal review has been completed there is no further route of appeal or review within the Council.

Kind regards

Dear Mr Knight

Thank you for your reply.

I had thought that the offer made by Mr Taylor in his Conclusion that "We will do this on your behalf if you require" was in relation to acquiring the information that I requested, from Yorkshire Water on my behalf.

Is this not what he meant?

And your link is showing the following error message "Page Not Found".

Yours sincerely,
Dr Shetty MRCVS

FOI, Sheffield City Council

Dear Dr Shetty,

Apologies, I was unaware that the offer had been provided in the internal review. However; this is not a service that the Council would normally provide. There is no onus under the Freedom of Information Act or the Environmental Information Regulations for Sheffield City Council to request information from third party organisations on behalf of a requestor. As we have provided you with details of how to make a request to Yorkshire Water I would like to confirm that Sheffield City Council will not be contacting this organisation on your behalf.

It is not clear if the link you are having trouble with is the link to Yorkshire Water's EIR page or the link to the current plans/ consultation page. The links below have worked for me so it may be worth attempted to use them in another browser; however I've also provided further details on how to locate the relevant pages:

Yorkshire Water EIR page: https://www.yorkshirewater.com/about-us/....

If this fails I would use the main website http://www.yorkshirewater.com and enter in the search field (magnifying glass on the left hand side of the page) "Environmental Information Regulations".

Flood management plans page: http://www.floodprotectionsheffield.com/....

If this link is failing I have used the search term "Endcliffe Park flood storage area" in a trio of search engines available on the web and they all populate the correct site as the first search hit.

I hope this confirms the Council position and provides some further details to assist in locating the information you are hoping to obtain.

Kind regards
