Complete Non-Residential / Business Property Rates Data (Q4 2017)

Response to this request is long overdue. By law, under all circumstances, Derby City Council should have responded by now (details). You can complain by requesting an internal review.

Dear Derby City Council,

In terms of the Freedom of Information Act of 2000, and subject to section 40(2) on personal data, could you please provide me with a complete and up-to-date list of all business (non-residential) property rates data for your local authority, and including the following fields:

- Billing Authority Reference Code (linking the property to the VOA database reference)
- Firm's Trading Name (i.e. property occupant)
- Full Property Address (Number, Street, Postal Code, Town)
- Occupied / Vacant
- Date of Occupation / Vacancy
- Actual annual rates charged (in Pounds)

If you are unable to provide an absolute “Occupation / Vacancy” status, please provide the Exemptions and / or Reliefs that a particular property may be receiving.

Please provide this as machine-readable as either a CSV or Microsoft Excel file, capable of re-use, and under terms of the Open Government Licence.

I last requested this data three months ago, and this is a request for an updated and current dataset.

I'm sure you get many requests for business rates and responding and managing these FOIs must be costly for you. Could I request that - as more than 53% of local authorities already do - you update and release this dataset via a dedicated page on your local authority website or on an open data service. I can recommend approaches for you to consider, and you should find that this reduces the time and cost of this request process.

‘Business Rates List’.

Your request is being considered and you will receive the information
requested as soon as possible, but in any case by 6 November the statutory
timescale of 20 working days as defined by the Freedom of Information Act
2000 (FOI) unless the information requested is subject to a statutory
exemption on disclosure or the information contains reference to a third
party.

 

For your information, the Act defines a number of exemptions, which may
prevent release of the information you have requested. Some exemptions are
subject to a public interest test. There will be an assessment and if any
of the exemption categories apply and any relevant public interest test is
weighed in favour of withholding the information it will not be released.
You will be informed if this is the case, including your rights of appeal.

 

If the information you request contains reference to a third party then
they may need to be consulted before a decision is taken on whether the
information can be released to you. You will be informed if this is the
case.

 

There may be a fee payable for supplying the information in the form of
disbursements. This will be calculated and you will be informed if a fee
is payable. The fee must be paid before the information is released and
the 20 working day time limit for responses is suspended until payment is
made. You will have 3 calendar months to submit your payment.

Dear Gavin Chait,

 

Thank you for your request received 09/10/2017 under the Freedom of
Information Act 2000 (FOIA) for, ‘Information on DCC’s Business Rates
List’.

 

The Council has considered your request and part of the information is
covered by an exemption under Freedom of Information Act 2000.  We have
attached part of the information and this email is a Part Refusal Notice.

 

The exemption applied is -

 

Section 31 – Law enforcement – applies to ‘list of empty commercial
properties’ because the information could identity the owners.  Also, the
information would be published on our website (in the public domain) and
could be used to target empty commercial properties for criminal purposes.

 

There is a public interest in releasing the information to promote
transparency and accountability of the Council and to raise the profile of
unused or vacant commercial properties in order to lead to a better
informed public and to encourage public debate.

 

However, this is outweighed by the public interest in protecting society
from the impact of crime and to not release information which is likely to
facilitate or encourage crime.

 

For your information this request has cost the Council £18.75 to process.

 

You can ask for the decision not to disclose the information to be
reviewed under the Council’s FOI Complaints Procedure.  Please send your
appeal reasons within 40 working days to the –

Thank you for your perplexing response. This is the fifth time I have requested these data from you. On every previous occasion, you have provided the data as requested. See:

Understand also that Regulation 31(1)(a) refusals have already been investigated and found against by ICO. In November 2016, I appealed this class of refusal - specifically as it relates to this request - to the Information Commissioner’s Office and they issued a Decision Notice (FS50628943 - https://ico.org.uk/media/action-weve-tak..., and FS50628978 - https://ico.org.uk/media/action-weve-tak...) on 28 February 2017 finding that “it is not correct to withhold this information under Regulation 31(1)(a)”, and that “the public interest in the information being disclosed outweighs that in the exemption being maintained”.

Could you please provide the data as requested. Note this is not a request for internal review and any further refusal will trigger a referral to ICO.
