Complete Non-Residential / Business Property Rates Data

The request was successful.

Dear Derby City Council,

In terms of the Freedom of Information Act of 2000, and subject to section 40(2) on personal data, could you please provide me with a complete and up-to-date list of all business (non-residential) property rates data for your local authority, and including the following fields:

- Billing Authority Reference Code (linking the property to the VOA database reference)
- Firm's Trading Name (i.e. property occupant)
- Full Property Address (Number, Street, Postal Code, Town)
- Occupied / Vacant
- Date of Occupation / Vacancy
- Actual annual rates charged (in Pounds)

If you are unable to provide an absolute “Occupation / Vacancy” status, please provide the Exemptions and / or Reliefs that a particular property may be receiving.

Please provide this as machine-readable as either a CSV or Microsoft Excel file, capable of re-use, and under terms of the Open Government Licence.

We last requested this data three months ago, and this is a request for an updated and current dataset.

I'm sure you get many requests for business rates and we intend to update this national series every three months. Could we request that - as more than 30% of local authorities already do - you update and release this dataset via a dedicated page on your local authority website or on an open data service. You should find that this reduces the time and cost of this request process.

Yours faithfully,

Gavin Chait

Dear Gavin Chait,

Thank you for your request received on 29/3/17 under the Freedom of
Information Act 2000 (FOIA) for ‘business rates information’.

I confirm that the Council holds information that falls within the
description specified in your request.  We have attached part of the
information but in accordance with the Freedom of Information Act 2000
this part of the email acts as a part Refusal Notice.

The following exemptions apply to ‘sole trader’ information which has not
been included in the response.

Section 12: Exceeds appropriate limit

This exemption applies because the Council’s Business Rate system does not
identify ‘sole traders’. It would take 542 hours to carry out a manual
exercise to search / identify / extract sole trader information from over
7200 records which would exceed the 18 hours £450 appropriate limit
specified in regulations.  This represents the estimated cost of one
person spending 2½ working days in determining whether the Council hold
the information, and locating, retrieving and extracting the information

Section 40(2) Personal data – third party

This exemption applies to all data held in relation to individuals who are
not participating in any commercial activity and therefore cannot be
classified as; a company, sole trader or private landlord. Disclosure
without explicit consent would be unlawful - contravene principles 1 & 2
of the Data Protection Act 1998.

For your information this request has cost the Council £12.50 to process.

If you are unhappy with this response to your request, you may ask us to
carry out an internal review.  Please put your appeal reasons in writing
and send it within 40 working days to…

Dear FOI,

Thank you for the data provided, however the billing authority reference number, which we use to match your data to the VOA master list, has data quality issues. It appears that the significant digits have been lost, leaving identical references for multiple properties.

Please could you correct this and provide an updated version of your data.

Yours sincerely,

Gavin Chait
