Dear Mr Chait,
Thank you for your information enquiry in regards to Business Rates. This has been passed to me
to be processed under the terms of the Freedom of Information Act 2000 (“FOIA”). Unfortunately,
on this occasion I am unable to oblige your request as I find that it meets the exemption at Section
22 of the FOIA-
Information intended for future publication. The requested data is available on the council’s website. You can access this via the following
link:
http://www.hinckley-bosworth.gov.uk/info/200307/business_rates_foi_requests. This information is updated on a quarterly basis; we are currently in the process of producing
further data sets for future publication in the public domain.
Section 22 states:
(1) Information is exempt information if –
a) the information is held by the public authority with a view to its publication, by the
authority or any other person, at some future date (whether determined or not),
b) the information was already held with a view to such publication at
the time when the request for information was made, and
c) it is reasonable in all the circumstances that the information should
be withheld from disclosure until the date referred to in paragraph a).
Section 22 can be applied in circumstances where we can confirm that the council holds the
information requested. However it is exempt from disclosure because it is intended for future
publication. In line with the terms of this exemption, we have considered whether it would be in the
public interest for us to provide you with the information ahead of publication, despite the
exemption being applied.
In this case, we believe that the information is of interest to a wide section of the general public,
this is evident from the volume of requests we receive under the FOIA. To answer each request
individually would impact on the council’s time and resources as well as resulting in cost to the
public purse. For this reason, we publish our figures quarterly. Therefore, we are not able to
answer your queries at this stage, as to disclose the information piecemeal to individuals under the
FOIA, rather than publication of the completed dataset would not be in the public interest.
I have concluded that the public interest favours withholding the information on this occasion. For
your information, this letter constitutes a refusal notice under Section 17.1 of the Act.
