I refer to your request for information received on 06/10/2014.  Responses
are provided below; however I would refer you to the Chief Executive’s
letter to you dated 22^nd October 2014 in which you were reminded that you
had previously exhausted the Council’s complaints procedures in relation
to your complaints about the Council Tax service.  It is the Councils view
that your requests for information are inextricably linked to your
attempts to re-open these matters, and so please be aware that the Council
will now give careful consideration as to the extent to which any future
information requests may be refused as vexatious under section 14 of the
Freedom of Information Act. 

 

I require of you the following:

The number of complaints you have made to the Magistrates Court for
Council Tax issues in the last 6 years? 

See table 1 at the bottom of this main FOI response.

 

The dates you have made complaints to the Magistrates Court in the last 6
years?  

See table 2 at the bottom of this main FOI response.

 

Copies of the documents that are submitted to the Magistrates Courts with
complaints?

See Appendix 1 - a blank copy of the application for summonses.  This is
sent with the complaint list, made up of all the names, addresses and
details of debt of all the cases where the issue of a summons is being
requested. 

 

Copy of the agreement with the Magistrates Court to have hearings at the
Magistrates Court at regular intervals? 

See Appendix 2 – the listing arrangement sent by the Court to all relevant
Local Authorities for that court.  You will see Wandsworth council tax
scheduled for the afternoon of the 4^th Tuesday of every month.

 

That the local councils hire the court rooms as venues?

The Council do not hire the Court Rooms.

 

How much Wandsworth Borough Council pays HMCTS for the venue of the court
rooms?

The Council do not make a payment to HMCTS for the Court Rooms.

 

Copy of the agreement with the Clerk to the Magistrates for the costs
incurred by Wandsworth Borough Council in issuing the summons?

See Appendix 3 - For each defendant, i.e. each liable party on a relevant
council tax account on the complaint list, the Council pay the Court
Services £3.00 for every summons issued.  The costs are prescribed in the
Magistrates’ Court Fees (Amendment) Order 2014, regulation 4.1.

 

The hearings that occur in these proceedings; is there a record of any
orders kept with HMCTS? 

Yes, the Court hold a record of all the liability order court hearings by
keeping a signed copy of the authority to grant the Local Authority the
liability orders (Schedule 2 (Form B) of the Council Tax (Administration
and Enforcement) Regulations 1992) and a copy of the listing for each
court session, made up of all the names, addresses and details of debt of
all the cases where a liability order has been requested.

 

Who issues the orders made at these proceedings?

The authority to grant the Local Authority the liability orders is given
by either a District Judge, the Clerk to the Court or a Justice of the
Peace for the South West London Local Justice Area.

 

Is the hearing a private administration procedure or a public judicial
one?

The hearing is a public judicial hearing.

 

Do CPR rules apply to these hearings?

Please refer to the Court services for this information.  This is not
information held by the Council.

 

Break down of the cost incurred in issuing the summons? 

See Appendix 4 for breakdown and Appendix 5 for letter dated 14^th January
2011 from the Court agreeing the costs.

 

What accounting standards you have applied to recognise the cost incurred
in issuing the summons in Wandsworth Borough Council’s financial
statements?

 The costs incurred in issuing summons for Council Tax are included within
the line “Central services to the public” in the Comprehensive Income and
Expenditure Statement on Page 25.

The 2013/14 accounts confirm at Page 2 that the “accounts have been
prepared in line with the Code of Practice on Local Authority Accounting
in the United Kingdom (the Code) with defines proper accounting practices
for local authorities in the England, supported by International Financial
Reporting Standards (IFRS)”.

The Council is still subject to audit by auditors appointed by the Audit
Commission; the National Audit Office will take over from April 2015.  The
audit certificate from the current Auditors, PricewaterhouseCoopers is
included in the accounts, Pages 16 to 18.
