Following your emailed complaint of 24 December 2013, which was
acknowledged on the same date, I am writing to confirm that your complaint
(concerning the CoL’s revised response on 4 January 2013 to your request
for information of 23 November 2012) has been reviewed by me as Head of
Corporate Performance and Development.
By way of summary, in your original request for information, dated 23
November 2012, you asked:
“How many complaints have been lodged about City of London staff, managers
and directors by the public and colleagues between October 1, 2009 and the
present date?
How many complaints, as specified above, have been found in favour of the
complainant?”
In our initial response to this request (20 December 2012), we
inadvertently provided you with an incomplete response which was
subsequently corrected (4 January 2013) as follows:
“How many complaints have been lodged about City of London staff, managers
and directors by the public and colleagues between October 1, 2009 and the
present date?

How many complaints, as specified above, have been found in favour of the
complainant?
14 (with an additional 4 which were only partially found in favour of the
complainant).”
In your emailed complaint of 24 December 2013, you stated your belief that
the figures stated in the CoL’s response of 4 January 2013 were incorrect
(although you did not specify any particular figure), based on the
response provided by the CoL’s Department of Community and Children’s
Services on 3 January 2013, to a similar request which was submitted by
you on 29 December 2012. A copy of that response is below:
“How many complaints have been lodged against the City of London
Department of Community and Children’s Services, its staff, officers and
directors between October 1, 2009 and December 20, 2012 by:
1. Tenants = 14
2. Members of CoL staff = 0
3. The general public = 10
How many of the total complaints as detailed above have been resolved in
favour of the complainants?
3 upheld, 4 partially upheld
How many of the complaints as detailed in the first question were made in
the years
2010 = 7
2011 = 6”
Having now reviewed your complaint I can confirm that the information
disclosed to you in both responses (3 and 4 January 2013) was correct.
I also note that the two requests to which you refer are worded
differently (as demonstrated below) with regard to the type of complaint
requested, resulting in the requests, and the statistical responses, not
being directly comparable.
Request of 23 November 2012:
“How many complaints have been lodged about City of London staff, managers
and directors by the public and colleagues between October 1, 2009 and the
present date”
In this request you asked for complaints made only about CoL employees
(staff manages and directors). As a result, the wording of your request
did not include any complaints made about the CoL in general, or the
services it provides (ie complaints which were not about employees).
Request of 29 December 2012:
“How many complaints have been lodged against the City of London
Department of Community and Children’s Services, its staff, officers and
directors between October 1, 2009 and December 20, 2012 …”
In this request you asked for complaints made about the employees of the
Department. However, you also asked for complaint made against the
Department itself, ie complaints which were not about specific employees
but about the services provided by the Department. This was not an element
included in your request of 23 November 2012.
In light of the above, my view is that your complaint is not upheld and
the CoL need take no further action.
