Environmental Health (Protection) have had 122 Service Requests covering
the whole of Ongar Road Trading Estate since 2004.

The majority of the service requests relate to waste collections, pest
control  or taxi licensing which were all actioned as necessary.

I am writing to request an internal review of Uttlesford District Council's handling of my FOI request 'Complaints received due to activities at Ongar Road Trading Estate, Great Dunmow.

Dear Sir/Madam,

Thank you for your response. Unfortunately, it appears that the records you have provided are incomplete, for example, you state that no complaints were made in 2013, and I am certain complaints were actually made during that year. Please therefore supply a full and complete list of complaints, as originally requested.

In all but one of the 22 cases of complaints of noise listed, the outcome of each complaint is reported thus; “informal discussions with the business operator, file closed as no nuisance established.”

I asked for the councils action in each case, and I would therefore like to know exactly what the council did after each complaint; if a visit was made to the site to investigate the complaint, or was just a phone call made to the business operator, or was no real action taken.

I therefore require you comply with my original request and reveal the actual action taken in each case by the council, ie, dates and times of all communications, phone calls/emails etc, made to the business operators, the contents and responses of those communications, and details of any investigative site visits made, in each case.

I see that on 05/02/2013 a complaint was made regarding unauthorised change of use from B1 to B2. This file is still marked ‘pending’ nearly 6 years later. Please explain.

Although it is very difficult to decipher the contents of your letter, as the records have been simply drawn from a computer and not formatted properly in order to be easily legible, it appears that on 16/12/2014 a complaint was made regarding conditions not discharged relating to permission granted at Unit 17, and this file was closed on 12/9/2016, stating it is “not expediant to pursue the discharge of the condition of the planning approval”. Please explain the reason for this decision, and the extended time taken by the council to reach the decision not to act.

As previously advised, the documents were being redacted prior to third
party consultation.  Since then third party comments have been received
and these are being considered.  Unfortunately, this process has coincided
with staff holidays which has lengthened the procedure.  Once the comments
have been assessed a decision will be taken on any redactions that need to
be made before releasing the documents to you.
