Dear John Allison (Information Officer),

Your Ref: NCC-023395-16
My Ref: https://www.whatdotheyknow.com/request/c...

Thank you for your reply attaching copies of the complaints held on file.

I can see that out of the 8 questions asked on the FoI request, you have only answered question 5 - 8, but left 1 - 4 blank. I understand that you have attached the information from the request, which fully answers question 2 & 3; these were rhetorical questions.

For the purpose of clarity and fulfilling the FoI request, could you please refer to your previous correspondence and remit answers to questions 1 & 4? Also please clarify responses to questions 5 & 6. Please see comments below.

Just to confirm;
Q1 = outstanding
Q2 = rhetorically answered by the records attached
Q3 = rhetorically answered by the records attached
Q4 = outstanding; please do not refer me to the records - I am asking of how NCC/VIA have acted upon receiving the complaints, i.e. did you only reply to these complaints? Did you do anything else? Did you investigate?
Q5 = not answered fully; was replying to emails the only action taken?
Q6 = not answered fully; the link supplied does not explain what type of investigation was taken nor any type of outcome
Q7 = answered fully for the purpose of the FoI request
Q8 = answered fully for the purpose of the FoI request

Just to note, under FoI Act, I do expect a response ASAP as this is apart of the original FoI request (ref: NCC-023395-16).

Thank you in advance

Kindest regards,
J Johnston

Dear John Allison (Information Officer),

Your Ref: NCC-023395-16
My Ref: https://www.whatdotheyknow.com/request/c...

As per my previous email sent to you tonight (14/01/17 - 19:33hrs), I forgot to include my comments in regards to enquiries that NCC/VIA may have received by post. As a part of my FoI request, I did ask for copies of every single complaint/comment/enquiry in regards to the A57 Millhouse roundabout improvements, whether this be by phone, email or letter. I see that on the document 'Enquiry records 2 Redacted.pdf' there are a few enquiries that refer to letters received from customers - where are these please?

Please therefore remit copies of ALL paper enquiries received by NCC/VIA, ASAP.

Thank you.

Kindest regards,
J Johnston

Dear Nottinghamshire County Council,

Please pass this on to the person who conducts Freedom of Information reviews.

Your ref: NCC-023395-16

I am writing to request an internal review of Nottinghamshire County Council's handling of my FOI request 'Complaints re A57 Millhouse roundabout improvements'.

Timeline:
- Originally sent a FoI request on 7 December 2016
- Received acknowledgement of the request on 8 December 2016
- The legal timeframe for a public body to reply to a FoI had passed
- I sent a follow up chase on 10 January 2017
- Received an apology for the delay email on 11 January 2017
- Received an satisfactory response to the FoI request on 12 January 2017
- I replied on 14 January asking for certain questions on the request to be answered as answers were missing or for answers to be looked at as they were not of satisfactory nature

Today, dated 25 January 2017, I write asking for an internal review as I believe the request has not been handled correctly as per the FoI Act.

1. Response was late
2. Response was not adequate as per FoI Act; either answers were missing all together or answers were not full enough so therefore no answering the question properly (full details can be seen on the 14 January 2017 reply)
3. No response to my 14 January 2017 reply has been received

Please conduct an internal review based on the above information. I do still require answers to my questions as per correspondence on 14 January 2017.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/c...

Thank you

Yours faithfully,
J Johnston

Dear Mr Johnston

I am writing to advise you that I have carried out a review of your
Freedom of Information request.  I hope my response now addresses your
questions in full and I apologise that the initial response was not as
clear as it could have been.

1)     Total number of complaints/comments received that are in regards to
the above subject.  6 formal complaints and 71 enquiries were received.

2)     A copy of all the complaints/comments received in their original
communication format (obviously with personal information redacted where
applicable), (i.e. if via email, please print and scan a copy, if via
telephone, please submit notes from the call).  These documents were
provided to you in the initial response and which are attached.  I can
confirm that any telephone enquiries which may have been made no notes
would have been taken as response would have been provided verbally.

3)     Any and all responses sent from NCC/VIA in reply to the
complaints/comments received.  These have previously been supplied and are
attached.  This is all the correspondence held in relation to your
request.

4)     Do you hold any information in regards to how either the NCC or VIA
acted upon receiving these comments?  The attached enquiry records will
indicate if an inspector carried out a site visit and if any action was
required.  If a response was required from the customer there will be a
record of this in the attachments previously supplied to you.

5)     5) Was any action taken upon receiving a complaint? If so, please
provide details of which complaint(s) this related to and what action was
taken.  The complaints and the responses are in the attachments previously
supplied to you with an explanation regarding why closure/diversion of the
road was required.  Any complaints which are received have to be responded
to within 20 working days.  As you will see in the attachments, responses
were provided but no action was required in relation to the actual
complaints, apart from a formal response.

6)     Were any complaints investigated? If so, please provide details of
which complaint(s) this relates to and what type of investigation was
taken, and furthermore the outcome of said investigation. No complaints
were investigated, a response was sent from the department providing an
explanation regarding the works being undertaken.

I trust this information is helpful to you.  Please contact me if you
require any further clarification.  Once again I apologise for the delay
in responding to your initial request, information needed to be gathered
from a number of service areas and this took longer than initially
anticipated.
