Section 1.13 of the complaints process states:

"Complaints lodged over 90 days after the act or omission complained of, or those lodged over three months after you have withdrawn or graduated will only be considered in exceptional circumstances".

Question 1.

Can you please tell me what legislative or legal right does St Mary’s University have to automatically dismiss a complaint after 90 days or 3 months after the act which is being complained about?

Question 2.

Where a complaint is subject to a matter of law can you please tell me what gives St Mary's University the legislative or legal right to automatically dismiss a complaint after 90 days or 3 months after the act which is being complained about?

I am writing to request an internal review of St Mary's University, Twickenham's handling of my FOI request 'Complaints process'.

You have failed to respond to my FOI request.

A student complained that he was charged accommodation fees upto the 8th April when he was told to leave the accommodation prior to the 23rd March Covid-19 lockdown, he made a complaint via the university complaints process but his complaint was dismissed as "out of time" despite St Mary's University stating in your 'student complaints procedure' that: [St Mary'sUniversity] "has due regard to any applicable law"

Obviously, the law supercedes any time restriction regarding a complaint. On the balance of probability St Mary's University rejected the complaint as being out of time due to the financial impact to the University of returning students money that is allegedly being overcharged upto the 8th April. Additionally, no due process has been given to the student how St Mary's University can lawfully charge accommodation fees upto the 8th April when the student was told to vacate (and left) the university accommodation prior to the 23rd March (coronavirus lockdown).

This is a serious public interest matter that needs answering.
