I refer to your request under the Freedom of Information Act 2000 for
information about complaints referred to Standards for England regarding
Councillor Stan Pajak of Swindon Borough Council.

To the best of our knowledge and following a search of our paper and
electronic records, the information you requested is not held by the
Standards Board for England.

You should bear in mind that complaints about breaches of the Code of
Practice for Elected Members are made in the first instance to a local
standards committee. It is for the local committee to decide whether or
not a complaint merits investigation and, if so, whether it can be
investigated locally or whether it is sufficiently serious or complicated
that it should be referred to Standards for England for consideration. It
may be that complaints have been made about Councillor Dickinson but that
these have been resolved locally. If that is the case then the Council
itself will be able to provide you will the relevant information.

If you consider that the decisions set out in this letter are wrong for
any reason or have a complaint about the way in which your request for
information has been dealt with you should write to Mr Tim Leslie, Acting

your case.

Dear Phil Boyd,

Thanks for your reply.

I am specifically interested in the 2003/2004 period, during which I believe a complaint about Cllr Pajak was lodged with the Standards Board For England.

This complaint was reported in the Swindon local paper in June 2003 and again in April 2004.

Thank you for the additional information. Now that I know the period in which you are interested I have been able to organise a
search of archived records and am able to supply you with a little more information.

1. As I previously advised, no complaints have been received regarding Councillor Dickinson. He was, however, mentioned in passing in the complaint against Councillor Pajak.

2. The only complaint received regarding Councillor Pajak is the one to which you refer.

I enclose a copy of the case summary which was prepared at the time and would have appeared on our website for two years after the case was closed before being archived. I hope that the summary contains the information which you are seeking. It may be worth noting that paragraph 4 of the Code to which the summary refers is equivalent to paragraph 5 of the Code currently in force.
