Dear North East Lincolnshire Council,

1) Did the council receive an anonymous complaint, via email, on 6th July
2023 about the conduct of a serving CLLR?

2) Did the council receive an anonymous complaint via email on 6th July 2023 about the conduct of a CLLR, towards two women, one holding a baby, whom were attending the Scartho ward surgery at Scartho library on Saturday 1st July 2023?

3). Which councillors / council officers / council officials / council employees were aware of, and are currently aware of, the existence of the complaint stated in Q1 and Q2?

4). Did the council investigate a complaint against the CLLR referred to in Q1 and Q2 and who was the named CLLR?

5). If the council did investigate, can you confirm what was the outcome of that investigation?

6). If the council did not investigate, on what basis was it not investigated?

7). Please name the legislation that requires complainants of CLLR conduct to make a complaint using a specific form / format?

8). Please name the legislation that states that a complaint about CLLR conduct, by a standard email, cannot be investigated?

9). Who is responsible for creating business plans when a maintained school has fallen into deficit - where is the NELINCS policy that explains this and where is it located on the NELC website?

I can confirm that North East Lincolnshire Council holds the following
information.

The information requested in questions one to six is deemed to be third
party personal information and is therefore exempt from disclosure under
Section 40 of the Freedom of Information Act, as disclosure of the
information if held would contravene the data protection principles and
rights of the data subjects. We are therefore unable to confirm nor deny
whether we hold the information held in relation to question 1 to 6 of
your request.

S28(6) Localism Act 2011 requires the Council to have arrangements in
place under which allegations can be investigated.  We are also guided by
guidance issued by the Local Government Association: [1]Guidance on Member

8). Please name the legislation that states that a complaint about CLLR
conduct, by a standard email, cannot be investigated?

9). Who is responsible for creating business plans when a maintained
school has fallen into deficit - where is the NELINCS policy that explains
this and where is it located on the NELC website?

 

The following guidance sets out the requirement to submit a recovery plan
(business case) when a school is in financial deficit. This is the
responsibility of the headteacher if the governing board has delegated
financial responsibility for the school to the headteacher. We refer you
to the following sections: 3.6: Delegation of powers to the headteacher;
