Dear Network Rail Limited,

During engineering works in the Wimbledon area on 15/4/18 you identified a 'defective track' which could not be repaired until after close of service on 16/4/18 (original estimate was after close of service on 17/4/18). This issue severely disrupted services through Wimbledon on 16/4/18.

Please provide the following infomation from any records you hold :

1) How much compensation, if any, you have paid/will pay to South Western Railway as a result of the service disruption caused;

If compensation has been/will be paid then :

2) An indication of whether this compensation was statutory/compulsory, or not;

3) If statutory/compulsory, which 'rule' applied in this case;

4) If not statutory/compulsory, all communication to/from South Western Railways negotiating the amount you have paid/will pay.

Dear FOI,

Thank you for your response. I am disappointed that you don't keep more detailed records at less than a four week period.

Instead, therefore, I would be grateful if you can provide me with the total amount of compensation you paid to SWR over the four week period in which the specific incident I referred to occurred. If possible, I would also be grateful if you can also provide me with the total 'delay attribution' (as you refer to in your response) for the same four week period, and the 'delay attribution' agreed for the specific incident I referred to.

For the avoidance of doubt, I have understood your most recent request to
be as follows:

 

1. The total amount of compensation Network Rail paid to South Western
Railway over the four week period in which the incident occurred (i.e.
Period 1 2018/19).

 

2. If possible, I would also be grateful if you can also provide me with
the total 'delay attribution', i.e. the number of delays, their cause and
to which party they were attributed for Period 1 2018/19.

 

3. For the same four week period, the 'delay attribution' agreed for the
delay which disrupted services through the Wimbledon area on 16th April
2018 and which occurred as a result of the ‘defective track’ identified
during engineering works on 15th April 2018.

 

I hope I have correctly interpreted your request and will proceed to

Dear FOI,

Thank you for your response today. It is not necessary to provide all details of the 'delay attribution' for either the period or the specific incident I requested information on. I presumed 'delay attribution' was simply an actual number (or ratio etc) upon which the compensation figure was based. Therefor I am only interested in the numbers used to determine compensation for the period and the specific incident, if such numbers exist. If not, the total amount of compensation for the period in which the specified incident occurred will suffice (and the length of the period ).
