Compensation Claims

The request was refused by Ministry of Justice.

Zahra Kassamali

Dear Ministry of Justice,

Could you please supply the following information under FOIA:

1. How many convictions for historic sex abuse (defined for this FOI request as cases relating to events claimed to have taken place between 1965 and 2000), where the convictions were subsequently quashed by the Court of Criminal Appeal (‘quashed conviction cases’) resulted in claims for compensation for wrongful imprisonment to MoJ.
2. How many of such claims for compensation for wrongful imprisonment were successful and compensation paid.
3. How many of such claims for compensation for wrongful imprisonment were unsuccessful and compensation refused.
4. How many decisions refusing compensation in quashed conviction cases relied in whole or in part on the wrongly imprisoned person’s failure to ‘prove’ their innocence.
5. How long, on average, did it take MoJ to reach a decision in quashed conviction cases.
6. What was the longest period of time between the lodging of a clam for compensation in a
quashed conviction case and the decision being made.

Yours faithfully,
Zahra Kassamali
