Community Centre where 95% of the MWA participants wanted to continue

The request was successful.

Dear Department for Work and Pensions,

I refer to your publication "Mandatory work placements:
a guide for potential host organisations" accessible at:
https://www.gov.uk/government/uploads/sy...

which says in part:

"Most of the participants may have the
wrong attitude to the government’s
plan for getting work experience to get
a job. However by the end of the four
weeks, 95% of the participants want to
remain on the placements.”
Community Centre Manager

1. From your records, please advise the name of the person quoted and the Community Centre concerned.

2. How many of the participants subsequently decided to become volunteers with that Community Centre?

Yours faithfully,

Mr Harris

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Work and Pensions's handling of my FOI request 'Community Centre where 95% of the MWA participants wanted to continue'.

You have refused to name the Community Centre claiming exemption from disclosure under sections 29(1)(a), 29(1)b, 36(2)(c) and 43(2) of the Freedom of Information Act 2000

I refer you to Department for Work and Pensions v (1) The Information Commissioner, (2) FZ [2014] UKUT 0334 (AAC) and ADMINISTRATIVE APPEALS CHAMBER Appeal Nos. GIA/2560/2013 GIA/2568/2013 & GIA/2569/2013 which in a similar case showed the claimed exemptions not to apply.

I accept your reasons for not sending me the name of the Manager and the number of volunteers.

Surely, it's now time to refer this to the ICO?

Mr Harris left an annotation ()

It's already done :-)

R Davis left an annotation ()

Look forward to reading their comments - wouldn't hold my breath though... the only time I've referred something to the ICO (a county council failure to disclose) took six months for the final response which mostly agreed with my requests.

Dear DWP Strategy Freedom of Information,

I refer you to the ICO Decision Notice Reference: FS50558511 visible at https://ico.org.uk/media/action-weve-tak... requiring you to disclose the name of the Community Centre.

I look forward to receiving this information without further delay.

Thank you

Yours sincerely,

Mr Harris

Good for you Mr Harris - keep on it!

Congratulations on the decision. It will be interesting to see if the DWP appeals ICO decision as it is trying a new exemption. Sadly it is happy to waste huge sums of public money on appeals but not help the unemployed, sick & disabled.

Dear DWP Strategy Freedom of Information,

Your offer of a reply by 14/4/15 is NOT acceptable.

Under the ICO Decision Notice FS50558511 dated 2/3/15 you are required to disclose the name of the Community Centre within 35 calendar days. Failure to comply can be dealt with as a contempt of court.

Yours sincerely,

Mr Harris

What an appalling reply from the DWP - they clearly believe that they do not need to comply with the FOI Act, or that they won't be prosecuted under it.

Get straight back to the ICO to press for contempt charges if this is possible, or at least inform them that they are ignoring their decision.

DWP look to be fighting this one all the way - "DWP has sought permission to appeal the decision of the Information Commissioner"

Dear DWP Strategy Freedom of Information,

I refer to the recent Court of Appeal decision in Department for Work And Pensions v The Information Commissioner & Anor [2016] EWCA Civ 758 (27 July 2016) visible at http://www.bailii.org/ew/cases/EWCA/Civ/...

In the light of this decision, you now have no legal reason to continue withholding the name of Community Centre I requested originally

The ICO has advised me to contact you to get this information I originally requested in https://www.whatdotheyknow.com/request/c...

Thank you

Yours sincerely,

Mr Harris

The ICO advise that the DWP applied to the First-tier Tribunal to seek its consent to withdraw its appeal. The Tribunal has consented to that withdrawal. Accordingly, the DWP should shortly disclose the requested information and within 35 days at the latest.
