Decision

NHS England holds information in relation to your request.

Please see attached all information which NHS England holds in relation to

We are withholding the names, job titles and contact details of NHS
England staff members at or below band 9 and those external to NHS
England, as well as the contact details for all other NHS England staff
under section 40 of the FOI Act as the information constitutes personal
data.

Section 40(2) states that requested information is exempt from disclosure
if the first or the second condition at section 40(3A)(a) of the FOI Act
is satisfied. This is on the grounds that it amounts to personal data and
the first condition under section 40(3A)(a) is satisfied, namely that
disclosure would amount to a breach of the first data protection principle
(personal data should be processed lawfully, fairly and in a transparent
manner) as the individuals concerned would have a reasonable expectation
that these particular items of personal information would not be disclosed
into the public domain. Section 40 is an absolute exemption and
consideration of the public interest test in disclosure is not required.

Please can you arrange for an internal review of this amalgamated response which is lacking in information on the following basis for communications (defined as “all papers, emails or other electronic communications”) between 1 July 2022 and 6 September 2022 involving Professor James Palmer and Charlotte Taylor, Charlotte Taylor and the Chief Medical Officer and the Chief Medical Officer and Professor James Palmer

1. The response does not contain any emails (whether as a primary preparer, recipient or cc’d) between:
Charlotte Taylor and the Chief Medical Officer and
The Chief Medical Officer and Professor James Palmer
Yet it is clear that some took place during this period from other information. Have you really searched this thoroughly?

2. Two emails provided dated 2 August 2022 and 24 August 2022 in which James Palmer and Charlotte Taylor are recipients/preparers start with the subject line “RE:” so are follow on emails. Yet the original mail or earlier correspondence that started this email conversation is omitted when it is clear that they are on this. Please provide these emails

3. The response does not provide details of any other papers, or other electronic communications communicated between these individuals. We know that WhatApp is well used by the CMO as a means of communication, are you really saying that this was not used between these individuals?
