FOI (NHS IMPROVEMENT - T1520), NHS Improvement

Dear Ms Tian,

We write further to your email below where you requested information from
NHS Improvement under the Freedom of Information Act 2000.

We have established that section 43 of the Freedom of Information Act 2000
may be applicable and we require more time to conduct the public interest
test.

Section 10(3) of the FOI Act 2000 enables an authority to extend the 20
working day limit up to a reasonable time in any case where;

o it requires more time to determine whether or not the balance of the
public interest lies in maintaining an exemption; or
o it needs further time to consider whether it would be in the public
interest to confirm or deny whether the information is held.

We confirm section 43 of the FOI Act 2000 is a qualified exemption which
requires the use of the public interest test and therefore falls within
this scope.

NHS Improvement will endeavour to provide a response to you no later than
by 25 September 2018.

Yours sincerely
